Any person, pa t I I ip or corporation using tr tank vehiclesfor <br /> nixing, spraying or applying pesticides or herbicides in the Town of <br /> ashpee shall be registered and licensed by the Board of Health. The <br /> registration form shall provide the name and address of the owner(s) ; <br /> the names and address of the operator(s) ; the license certi- <br /> ficate number(s) of all applicator(s) with expiration date(s) in <br /> accordance with the Massachusetts Pesticide control Act and regulations <br /> adopted thereunder; a description of the anti-backflow prevention <br /> device; a description of the manner whereby the tank vehicle is to <br /> acquire water; a description of the source of water to bE used; and if <br /> from a public or private water utility in the Town of Mashpee, a <br /> written statement from the utility indicating the date(s) and locations <br /> of the hydrant(s) to be used for filling purposes. The information n <br /> this fora shall be kept current at all times by the person responsible <br /> for the operation- of the water tank vehicle. The license fee shall be <br /> $50.00. The purpose of this license and registration requirement is to <br /> permit the Board of Health and its agents to observe and monitor the <br /> method of acquisition of water by any water tank vehicle used in the <br /> Town for pesticide or herbicide mixing, spraying or application, in <br /> order to ensure that there is no introduction of pesticides or herbi- <br /> cides into the sole source aquifer. <br /> Any public or private water utility in Mashpee furnishing water to any <br /> water tank vehicle used for the nixing, spraying or application of <br /> pesticides or herbicides, shall not allow any backflow into the private <br /> or public water system. <br /> . All inspection t i cher and licenses issued by the Board of ea l th,pur- <br /> suant to this regulation, shall expire December 31 and shall be renewed <br /> annually. <br /> . Whomever personally, or as agent for any person or business entity, <br /> violates any of these regulations, may be punished by a fine of not <br /> more than $200.00. Each violation shall constitue a separate offense <br /> punishable by a fine and/or revocation of the license. <br /> 10. 1n the event any part or section of these regulatio-ns is deemed invalid <br /> or unlawful , such part- or section shall be deemed severed front the <br /> other sections or parts which shall continue in full force and effect. <br /> This regulation is adopted by the Board -of Health on August 24, 1989 and <br /> replaces the Pesticide Spraying Fegu1ation adopted May 1 , 1989.
