MA 02649 <br /> X77.17'77 <br /> LEGAL NOTICE <br /> ADDENDUM To BOARD of HEALTH REGULATION ADOPTED FEBRUARY 8, 1985 <br /> Notice is hereby iv n that the following addendum to the Mashpee Board of Health <br /> regulation, adopted on February 8. 1985, has been adopted under the provisions of <br /> Massachusetts General Laws, chapter 111 , Section 1 : <br /> Replace subsection 2 of said regulation entitled "LEACHING REQUIREMENT - DIST NCESIF <br /> which reads: <br /> (2) "All distances shall be measured from the average of the mean annual <br /> flood elevation in inland areas and from mean high water in coastal <br /> areas." <br /> with the following: <br /> (2) "Watercourse are defined as any natural o a n-made stream, pond, lake, <br /> wetland,, coastal wetland, swamp or other body of water and shall include <br /> wet meadows,, marshes, bogs and areas where groundwater, flowing r stand- <br /> ing surface water or ice provide a significant part of the substrate <br /> for a plant commulnit for at least five months of the year. <br /> Swamp shall m -an areas where groundwater is at or neer the surface of the <br /> ground for a significant part of the growing season or where runoff water <br /> from surface drainage frequently collects above the soil surface. <br /> Coastal wetland shall mean any marsh, swamp, flat or lowland subject to <br /> tidal action and not covered under the Mashpee Board of Health regulation <br /> entitled "Soil Stability",, adopted September 21 , 1989. <br /> Distances shall be measured from the average of the mean annual flood <br /> elevation i n inland areas or from the mean high water mark in coastal <br /> areas where the edge of the wetland does not extend beyond this point. <br /> The wetland delineation shall be shown on the septic plans drawn by a <br /> professional engineer and verified by the Mashpee Conservation Commis- <br /> sion <br /> i -sion or its agent." <br /> This addendum to the Mashpee Board of Health regulation adopted February 8, 19859 <br /> shall take effect on the date following publication. <br /> George R.
