1 <br /> W; <br /> of <br /> S <br /> BOARD OF HEALTH <br /> i / <br /> P. , BOAC 1108 <br /> ' BLE I A HPEE, MA 02649 <br /> 477-1777 <br /> LEGAL NOTICE <br /> Notice is hereby given that the following regulation has been adopted by the Town <br /> of a shpoo Board of Health,, under the provisions of Massachusetts Gen ra l Laws, <br /> Chapter 111 , Sections 31 and 127A. <br /> SOIL STABILITY <br /> No newly constructed septic systems, nor expansion of existing septic systems shall <br /> be permitted within 150 feet of any area where there is active shifting of sands or <br /> earth-. The delineation of such areas shall be shown on a plan drawn by a Professional <br /> Registered Engineer and verified by the Mashpee Conservation Commission or its agent. <br /> These areas shall i roc l ud : � <br /> a. Coastal beaches to include ars unconsolidated sediment subject t wave tidal <br /> y � <br /> and coastal storm action which forms the gently sloping shore of any body of salt <br /> water and includes tidal flats. Coastal beaches extend from the mean low water line <br /> landward to the dune line, coastal bank line or the seaward edge of existing man- <br /> made structures, when these structures replace one of the above lines, whi h v r <br /> is closest to the ocean; <br /> b. Coastal dunes, to include any natural hill , mound or ridge of sediment landward <br /> of a coastal beach deposited by wind action or storm overwash, Coastal dune also <br /> includes any sediment deposited by artificial ren for the purpose of storm damage <br /> prevention or flood controls <br /> c, Barrier beaches, to include any low-lying strip of land generally consisting of <br /> coastal beaches and coastal dunes extending roughly parallel to the trend of the <br /> coast. It is seperated from the mainland by a narrow body of fresh, braki sh or salt <br /> water or a marsh system. A barrier beach may be joined to the mainland at one or <br /> both ends. <br /> d. Coastal banks composed of unconsolidated sediment, to include the seaward face <br /> or side of any elevatedlandform, Qther than a coastal dune, which lies t the land- <br /> ward edge of a coastal beach; land subject to tidal action, or other wetland, These <br /> banks are exposed to vigorous wave action and through that action serve as a major <br /> continuous source ,of sediment for beaches, dunes and barrier b .aches as well as <br /> other} landforms caused by coastal processes. Coastal barns with previously existing <br /> man-made structures such as seawalls, riprap, revetments and bulkheads are exempt <br /> from this provision. <br /> Variances from this regulation may,at the Board of Health's discretion, require <br /> satisfactory documentation from a hydrogoologist or professional sanitary engineer <br /> at the applicant' s expense. <br /> This regulation shall tale effect on the date following publication. <br /> George R, Costa, Chairman <br /> Stephen J.
