Ball asked if he could see the bill. <br /> Mr. Kerrigan shoved Mr. Ball the bill and explained this was one bill when they <br /> were going to put the system in. Mr. Labute wanted $8000-00. <br /> Mr. Ball asked if Mr. Kerrigan paid him that money. <br /> y. <br /> Mr. Kerrigan confirmed that he had paid him that money. He had a subsequent <br /> bill, which he showed to Mr. Ball, which stated that it was paid in full. He <br /> continued by stating that he gave Mr. Labute half in advance and thea gage lair <br /> the other half when he was working on it. That is when they started to get in <br /> trouble. They had ordered another Microfast system from the company. He was <br /> going to forget the thirty something hundred dollars that he had paid therm. He <br /> was trying to got into his house. At the end, it just continued. Mr. Labute <br /> wouldn't show up. He wouldn't back fill it. He finally rare out of patience and had <br /> someone else back fill it. He bought some loam, some stone and did the final <br /> ceding. Thea he contacted the engineer who provided and as guilt plan, He ran <br /> into a technicality where Mr. Labute was supposed to supply a card. Now the <br /> actual practice is that the engineers are the ones that measure the systems. He <br /> doesn't even think that Mr. Labute did. He is trying to hold him up because they <br /> have a dispute on the balance. He sent Mr. Labute a letter. For instance, there <br /> was one change in the plans. They had designed for a 1500-gallon tanl with <br /> Mierof st system in the tank. Mr. Labute put in a 1000-gallon tank. well that <br /> a ... ith the engineer and they notified the BOH. However, this is just an <br /> indication when it carne to ars adjustment on the bill Mr. Labute allowed him <br /> $300.00. But, the difference in the cost of the tank was almost $600.00. He told <br /> Mr. Labute he would pay him the balance plus the cost it would cost him to get <br /> his house completed because there were a lot ofthings Mr. Labute didn't do. <br /> i <br /> However, his contention is, is far as the system is concerned. He was paid in full <br /> for the system. He seat him a letter with the adjusted bill. He told Mr. Labute that <br /> when he got an occupancy permit he would pay him any monies due. Everybody <br /> j that worked on his house has been paid, it is not a big issue with ham. It got very <br /> frustrating at the end. He rare into a technicality with Mr. Labute having to supply <br /> a card. The card includes the measurements off the corner of the house. That has <br /> been supplied by the engineer. He thinks that at this point if himself and Mike <br /> have any problems they can be resolved in small claims court. when he gets this <br /> over with he will give him a check for what he feels he owes Mr. Labute. If he <br /> thirds he is owed any more he can make an issue with him. He had no problem <br /> with paying people but this became very, very difficult situation. He 'las been a <br /> homebuilder for quite a long time. He had never run into a problem like this <br /> before. <br /> Mr. Harrington joined the conversation by presenting the original septic plans for <br /> 1 <br />
