i
f
4
attorney got to J R Sales before Mr. Labute did and threatened them somehow.
Mr. Kerriga 's attorney called Mr. Labute and tried to threaten him. Mr. Labute
told his attorney that it is all in black and white.
Mrs. Labute joined the conversation and continued by stating that they sent Mr.
Kerrigan's attorney information regarding their business relationship. They refused
to pick it up.
Mr. Doherty joined the conversation and granted to hack the discussion up a bit.
He asked Mr. Labute if he was aware that the BOLI was holding meetings to
discuss this matter.
Mr. Labute replied that he was not notified.
Mr. Doherty asked Mr. Harrmi gt n if he had notified Mr. Labute.
Mr. Harrington replied that his dealing had been strictly with Paul Kerrigan.-He did
not notify Mr. Labute. He was going after Mr. Kerrigan. He asked the DOH what t
do. when he initially found out about this. He suggested to the DOH that he write
a letter and start fining Mr. Kerrigan if he doesn't vacate the property. The
alternative was to go after him to condemn the house. The DOH members'
recommendation at the time was to write Mr. Kerrigan a letter. If he didn't do what
the order letter said then the health agent should start fining him at that point. He
never picked up the letter because he was down in Key west, FL. He found out
about the letter. when he carne back up he requested a meeting with the DOH. He
carne in and met with the DOH. At the preceding meeting and at the meeting that
Mr. Kerrigan attended it was decided by the DOH members that ars order letter
should be sent to Mr. Labute advising him to provide the as built card no matter
' what the circumstances. The DOH felt that they should not be stuck in the middle
in what was presented as a monetary matter between two separate parties.
Mr.- Doherty continued that if he remembered too, some items where
misrepresented to the BOH members. For example, somebody told the BOH
members that essentially the system was paid for and Mr. Labute was withholding
the card for another reason.
Mr. Labute responded to this statement by saying that the system was $5600.00
for the whole shooting match.
Mr. Doherty asked if the system was paid for and J & R was paid.
Mr. Labute stated that J"&. R Sales was paid. But, they weren't paid for the
installation. They stopped doing everything. None of the stuff was even hoofed up.
Mr. Kerrigan did It himself. lir. Kerrigan ran the entire pipe to the compressor. You
don't have to be ars Einstein to do that. But, he hooked the D-box up. The
electrician had cone in and dict everything electronically.
Mr. Harrington interrupted Mr. Labute and stated that he would have gone after
Mr. Kerrigan for other things if he had known wn that information.
7
