i <br /> J <br /> Mr. Santos joined the conversation and stated that Mr. Kerrigan told the BOH <br /> members that the system was done and finished by Mr. Labute. Mr. Kerrigan did <br /> not come out and say that he finished the-project himself. Nor. Santos believed that <br /> Mr. Labute was withholding the as built card because you weren't paid for <br /> something else. <br /> Mr. Labute continued by stating that he is not going to hold the BOH liable <br /> because he is going to go after Il r. Kerrigan in court. Mr. Kerrigan made him look <br /> bad. <br /> Mr. Doherty continued that Mr. Labute was made out to be the bad guy in this <br /> natter. <br /> Mrs. Labute stated that they went to him several tines and asked for payment and <br /> the job would be completed. Mr. Kerrigan had already completed it in the <br /> meantime. He refused a letter that had been sent to him by then. They received a <br /> phone call from his lawyer. Then they received an itemized breakdown that Mr. <br /> Kerrigan wrote out of things that they didn't even have on the proposal to begin <br /> Frith. <br /> Mr. Labute continued that Mr. Kerrigan put a lawn in and in doing so he went over <br /> the hay hales and cut trees down. He expected Mr.Labute to pull the trees out with <br /> his machinery. He told Mr. Kerrigan that he wouldn't do that because he has t <br /> deal the'town every day. He was not going to be pulling trees out from the edge of <br /> the pond. Mr. Labute got in touch with Mr. Bob Sherman of Conservation <br /> Commission. Mr. Labute met Mr. Sherman out there. He told Mr. Sherman that he <br /> was not touching those stumps and Mr. Sherman agreed with him. The lawn has <br /> nothing to do with Mr. Labute. Mr. Kerrigan was supposed to put dry wells in. He <br /> never did it. All of Mr. Ker an's dirt is going next door.'The he next-door neighbor <br /> had an issue and contacted the building department. The department said in so <br /> marry words that what Mr. Kerrigan did was dig a big hole in one corner, dumped <br /> some stone and piped all of the down spouts in this area. That is the dry wells. The <br /> dry wells that were supposed to go in were supposed to be trent -four inch <br /> perforated with holes in the side and stone around it. It was to be regular schedule <br /> 40 or the cheap drainage pipe to put it in. Mr. Kerrigan did absolutely nothing. The <br /> Conservation Commission dropped the ball and the Building lepartrnent dropped <br /> the ball. They say that they can't do anything. It is making Mr. Labute look stupid <br /> in front of everybody. <br /> Ms. warden asked if she could interrupt him for a minute. Initially she received a <br /> call from Mr. Labute stating that the system wasn't put in properly and if she went <br /> out to the lot she would see the-pipe actually running across the driveway. She <br /> went out to the lot and sure enough there vas the pipe to the Fast System running <br /> right across the stone gravel drive way. it was only a PVC pipe that could very <br /> easily he broken. She knocked an the door and Mr. Kerrigan answered the door. <br /> She asked hire ghat it was. He stated that itwasn't finished being put in. She <br /> stated that the BOH had an as built card from the engineer stating that the system <br /> had been completed. She called the engineer- and informed him that the piping <br />
