This is based on the fact that all existing <br /> alternatives have not been explored. <br /> Mr. Mason asked if when he re-submitted the application would he re- <br /> submit it as a variance again. <br /> Mr. Doherty stated that that was if he wanted to. However, if Mr. Mason <br /> wanted to state tonight that they will re-submit this with a denitrification <br /> system. They would vote on it now conditionally based on receipt of the <br /> plan. They didn't want to hold him up. He understood that they were <br /> sometimes on a time schedule. That is not his intent. If Mr. Mason is not <br /> sure that his clients are going to go for this requirement. Then that is <br /> fine, too. If they want them to conditionally approve the plan with a <br /> denitrification system they can do that, too. <br /> Mr. Mason asked them to deny the request for a variance because he <br /> would rather check with his clients In regards to the direction they <br /> wanted him to go in with this matter. <br /> Mr. Ball seconded the motion made by Mr. Doherty. Mr. Doherty re- <br /> iterated that the motion was made and seconded. All in favor. Three <br /> Ayes. All opposed. None. Motion passed. <br /> 5. Request for 1/A System Approval -50 Popponesset Island Road <br /> Mr. John Slavinsky was present for the applicant, Mr. L. Clark Hill, on this <br /> particular piece of property. Mr. Slavinsky wanted to respond to Mr. <br /> Harrington's evaluation and comments in regards to the engineering <br /> plans for an innovative/alternative system for this particular location. Mr. <br /> Slavinsky began by stating that all of Mr. Harrington's comments in a <br /> normal situation are right on the money. This is not a normal situation. <br /> Basically they have already done most of what Mr. Harrington was <br /> suggesting in the beginning. Just the boathouse added into the existing <br /> house expanded the leaching. The BOH actually issued a permit. What <br /> happened is that Conservation found out. They went to the Conservation <br /> Commission. They said that that is fine and dandy, but when you do that <br /> don't file a notice of intent, which is basically a lien against the property, <br /> for the boathouse. They want the applicants to amend the order of <br /> conditions for the four-bedroom house. Their attitude is that they have <br /> 12 <br />
