had enough problems with their order of conditions that still isn't <br /> rectified over a particular deck on the property. <br /> Mr. Ball stated that that had nothing to do with the BOH. <br /> Mr. Slavinsky replied that that is why they have done what they have <br /> done. Mr. Hill says what we have to do here is do the boathouse with an <br /> entire separate septic system. Don't touch anything that has to do with <br /> the house that is already there. Conservation now at that time says well <br /> that is fine and dandy. Now you don't conform to our regulation of five <br /> parts per million of nitrogen loading. Even though they already a permit in <br /> hand from the BOH without the denitrification system. Then they agreed <br /> to denite the system. That was not good enough for the Conservation <br /> Commission. When you do a nitrogen loading calculation you are involved <br /> with grass and things like that. So what happened when they added the <br /> denitrification system they have to take out 1700 square feet of lawn just <br /> to appease the Conservation Commission and their by-law of the five <br /> parts per million nitrogen loads. It has nothing to do with the Title V <br /> regulation or a Mashpee BOH health regulation. All of Mr. Harrington's <br /> comments make sense if they were to tie the boathouse and the existing <br /> house into the same septic system. Right now they can't do that. They <br /> need a separate order of conditions, which they have, from the <br /> Conservation Commission to construct this boathouse and the septic <br /> system. That is where they are. <br /> Mr. Ball asked if the house had a denitrification system. <br /> Mr. Slavinsky replied that the house didn't need it. <br /> Mr. Ball said, "But here you are putting one in?" <br /> Mr. Slavinsky replied that Conservation was demanding it. They can <br /> because it is their by-law. <br /> Mr. Ball asked why they wouldn't take the septic system from the house <br /> and attach the boathouse to it and add a denitrification system. <br /> Mr. Slavinsky responded that when they do that they open...The order of <br /> conditions still exists on the house itself. It hasn't been solved. It is in <br /> litigation. This house has been there a while and it is still not settled. It is <br /> very close to being settled. The last thing in the world the Hills want to <br /> do is take a chance and fool with this system now after Conservation <br /> demanded that they alter or amend this order of conditions. They do not <br /> want to do that. It has been a war. It is that important to the Hills not to <br /> amend that order of conditions on the house. <br /> 13 <br />
