position. But...
Ms. Wa rden continued-that whoever is Servsafe certified is the person in
charge.
Ir..Doherty asked them to back up for a minute. He took the Daffodil
Days as an example. IVIS. Heidi Trottier is the servsafe person who holds
the certificate. But, she has nothing to do that with the Forty Niner's
Concession. Let's say that nobody there has one. This is a "what if'
scenario because according to the proposed policy that scenario would
be possible. Somebody gets sick and an attorney gets involved. Is IIT.
Trottier really responsible? She is net an employee of the Forty iner's
Concession. Why should she take that liability or responsibility? she i
doing there a favor and is not being paid to do this. That's all fine and dandy. But, if
somebody gets sick and starts to go looking for money. Who are they
going after? Do they go after the person who owns the property that was
letting them use it or the concession or the person who holds the
certificate or the torn Does the event need any special liability
insurance? He appreciates the intent. But, he sees ar problem with it.
Mr. Santos stated that in the food handling regulations it states that if it
is a temporary event there is no requirement that states that you have to
have a responsible person.
Mr. Doherty continued that he didn't want to set up a situation where this
person is volunteering their services as good will and then they get into a
problem because we didn't foresee something.
Mr. Harrington stated that in this case they really aren't worried. He
believes that there is some oversight. They are non-profit and they are
6
