He didn't have a problem with Mr. Wells request providing that it <br /> was under the scrutiny of the health inspector. <br /> Mr. Santos asked for Ms. Grady's opinion. <br /> Ms. Grady replied that she was a little leery of the request based on what <br /> Mr. Harrington had stated. <br /> Mr. Santos felt that it was a nice set up. However, he would have to agree <br /> with the health agent. He could envision them approving Mr. Wells and <br /> then they'd have requests from people to put them up in the rotary, Dick <br /> and Ellie's, etc. He stated that Mr. Wells' location was one of the few <br /> places that people could safely pull off the road to stop. If they approved <br /> him it would be hard to say no to the next one. He would vote to deny it <br /> because he wouldn't want to set a precedent. <br /> Mr. Bali asked for a motion to approve. No second. Ms. Grady made a <br /> motion to deny. Mr. Santos seconded it. Motion passed. Mr. Ball was <br /> opposed. <br /> Mr. Wells thanked the BOH members for their time. <br /> APPOINTMENT: Cape & Islands 58 James Circle <br /> Mr. Slavinsky was present for the applicants. He began by stating that <br /> they have an abutter that has a problem with a plume affecting his water. <br /> They have followed all Title V regulations and they are as far away from <br /> the well as they can be gradient-wise. The well water of the abutter is not <br /> coming in the direction of their septic system. <br /> Mr. Ball asked if that was the only variance they were requesting. <br /> Mr. Slavinsky replied that that was it. They tried to get less than 100' at <br /> one time on Pembroke. They needed a permit from DEP. They were denied. <br /> Then another engineer took another case of theirs where they didn't <br /> bother going through that and tried it again, down in Southcape, and they <br /> were also denied. He doesn't know if DEP had ever granted less than 1001. <br /> The DEP's deal was that you get some engineer to swear up and down that <br /> the water quality is the same at 89' as it is at 1001. Nobody was going to <br /> do that. It is an easy way to look at it. <br /> Ms. Grady made a motion to approve the variance of 25' from the SAS to <br /> the well. Mr. Ball seconded the motion.
