Mr. Carl Delorme was present as the applicant for this address. He began
by stating that they wanted to get away from the Ruck Septic System. He
has petitioned the BOH with the thought that he could go to a standard
Title V system since the water has been brought into the development.
Mr. Ball asked if the BOH required him to put a denitrification system in.
Mr. Delorme replied that that was correct because he only had access to
well and not town water.
Mr. Harrington confirmed that that was correct. They had no idea whether
town water was going to go down there or not. There was no commitment
from the water department at that time to run water down there. There
was no real indication for the BOH to vote on that fact. It was a nice
proposal at that time. But, it didn't have any teeth to it because it wasn't
in writing. Mr. Delorme was back before the BOH because he has it in
writing. He is waiting for the board to vote on that fact. He had the plans
approved for the denitrification system. This whole area is not in Zone 11.
Now that the wells have gone away he is not restricted. He went back to
the development and petitioned each of the owners within the
development and asked them to petition the water district to connect
them up to the town water.
Mr. Ball asked what the distance was from the well to the septic. Mr. Ball
asked if he used the open space regulation on that lot, which gave him his
three-bedrooms.
Mr. Delorme wasn't sure why he fell into that theoretical hole, so to speak.
Mr. Ball continued that he didn't understand because if he was using his
open space he was getting his 10,000 square feet per bedroom.
Mr. Delorme replied that he was just doing what he was told.
Mr. Ball was just trying to revisit the original decision and why it was
made.
Mr. Harrington asked Mr. Delorme if he ever when to DEP for the open
space.
Mr. Delorme replied that he didn't go to the DEP because he thought he
would petition the development as an alternative solution.
Mr. Harrington stated that he hadn't gotten the actual approval from the
DEP for the open space option.
9
