The property <br /> has grandfathering back in 1999. <br /> Mr. Ball asked if the leaching was over 100' from the BVW. <br /> Mr. Grotzke stated that in the plans that he had submitted for this <br /> meeting today it was over 100' from the BVW. <br /> Mr. Ball stated that it did not kick in their denitrification regulation. <br /> Mr. Grotzke stated that in the previous plan that Mr. Harrington was <br /> promoting it was within the 100' of the BVW. That was part of the reason <br /> that the new plan relocates it in the driveway. <br /> Mr. Ball stated that the concerns of the garage, house and deck are all <br /> conservation concerns. They are not BOH concerns. Mr. Grotzke is within <br /> the BOH regulation. He is only asking for one variance. He can't see why <br /> the BOH wouldn't grant it. He didn't want to step in conservations <br /> territory and he didn't want them to step into theirs. Mr. Grotzke is not <br /> within the 100' from the BVW. It doesn't kick the denitrification <br /> regulation in and he is only asking for a variance from the waterline to <br /> the sideline. It will be piped and encased. He couldn't see not granting <br /> the variance if this is what the homeowner wants. It was a shame he was <br /> taking the denitrification system out. <br /> A discussion ensued amongst the BOH members regarding the two <br /> separate plans. <br /> Mr. Ball made a motion to grant a variance from the property line side <br /> line setback of 1.5' as requested on 194 Fells Pond Road by Mr. Grotzke. <br /> Ms. Grady seconded the motion. Motion passed. <br /> 5. Request for Temporary Food Permit: Don Donahue Mashpee Community <br /> Concert Committee Zesty's Hot Dogs and Mashpee Chamber of <br /> Commerce <br /> Ms. Warden asked if the Mashpee Community Concert Committee asked <br /> if that was a correct request. She stated that they never had vendors ask <br /> for permits for that event. She asked if they had ServSafe. <br /> Ms. Garron noted that we've never received a request from them before. <br /> 4 <br />
