4 <br /> i <br /> Mr. Ball asked if the DPW was requesting the BOH not to waiver the <br /> $309.00 fine, which in his estimation they have no right to do. <br /> Ms. Grady replied that they dict have a right to do this because it is <br /> local ordirnance. <br /> Mr. Harrington began by stating that Mr. Ball had missed the previous <br /> discussion of this topic because he was absent from the board meeting. <br /> He stated that the DPW was telling the BOH net too. However, the BOH <br /> was enforcing their by-law. The $309.90 fine that the Bob# sets are based <br /> upon chapter 106-6 section 6, which is a town by-law, which is a <br /> Selectmen's purview. The BOLI is enforcing a town by-law of which vire <br /> are one of a number of departments. specifically the police, conservation <br /> and the DPI are the other departments that are allowed to enforce that <br /> by-law, <br /> IVIr. Bail stated that IVIS. Laurent is asking the BOH to enforce this by-laver <br /> against these people and she is the one who is making the citation. <br /> Mr., Harrington stated that Ms. Laurent is asking the selectmen to tell all <br /> of the departments, because they have jurisdiction over the by-lavers, not <br /> to waive the $300.90 fine,on a it is issued. His next recommendation is <br /> that the BOH respond in written format re-visiting the fact that the other <br /> departments may enforce this regulation, <br /> Ms. Warden stated that they always throw it at the Boli. <br /> Mr, Harrington continued that although AAs* Laurent doesn't say it in her <br /> letter conservation, DPW, the police and the BOH are included in the by- <br /> law as the departments who could enforce that by-law. <br /> Ms. warden added that she did inform Ms, Laurent that the DPW were <br /> allowed to enforce this by-laver and explained the procedures to her. Ms. <br /> Laurent never carne in to get any citations, <br /> Mr. Ball suggested that vire return the citation to therm and request that <br /> they enforce the citation because it was their citation not ours. <br /> Ms* warden replied that it was the BOH's citation. <br /> Mr. Bail stated that that was too bad. <br /> IVIS, Garron stated that all of the calls come to the BOH. They don't call <br /> the DPW when there is an illegal clumping. T- <br /> IVIr. Harrington stated that the DPI does there share. They put their time <br /> in because they have go out and pick up this stuff. He understands her <br /> 1 <br />
