Dight now the town is saying that they <br /> have to fully enforce a $300.00 fine on these people even though they did <br /> not directly cause the dumping, it was their trash, their mares and <br /> ultimately their responsibility. They hired by contract someone to come <br /> in and remove the trash who in turn dumped it in our woods over by <br /> John's Pond. They would have to drag them all the a to court basically <br /> y <br /> because the BOH was no longer going to have any leeway and play the <br /> heavy hand to say that they can't rescind its It will have to go to court. <br /> They would tie up court time and take it to a judge. The judge will <br /> probably laugh at it. He will recommend that they go after the contractor. <br /> The last two instances the court has actually just put their own court <br /> fees and rescinded their$300.00. The court got their$150.00 and the <br /> BOH has nothing to show for it because they rescinded the $300.00. That <br /> doesn't cover therm for all of their labor that they put in to get them there. <br /> They need to do a letter through the town~ selectmen and the court <br /> advising them of the fact that when they semi someone to therm there is <br /> a lot of time that goes into this process. They should at least allover them <br /> the $300.00 fora start and place the court fees on top of that and maybe <br /> this will curtail the illegal dumping, <br /> Mr. Ball stated and the court will look at it and throw It away. They have <br /> already pursued this method and it was unsuccessful. It wasn't worth it, <br /> Ms, warden stated than she had actually gone to court and got the <br /> $300.00. she gent to court main and they sided on the behalf of the <br /> elderly gentleman because he it was just possible that he.couldn't have <br /> physically illegally dumped the material, They rescinded the fine. This <br /> time they didn't even notify the town's own court appointed <br /> representative, Doug Flynn. They didn't notify Mr. Flynn who they sena <br /> 2 <br /> �f <br />
