Warden stated that the procedure is that Mr. Flynn will call the BOH <br /> and say that the hearing will be.held on such and such a date please be <br /> present. They go with Mr. Flynn, the court magistrate and the offender. <br /> They set something up. They haven't been notified the last three times. <br /> Mr. Ball stated that through past practice they have already been through <br /> this and it cost the town too much money well over the $300.00 just to do <br /> this. Why don't we just send them a letter stating that vire cannot abide <br /> by their request to waive the illegal. dumping fines? That they need to <br /> approach these situations on an individual basis in order to determine <br /> the best practical outcome for all involved parties. <br /> Ms, Warden added that they should include a reminder that the other <br /> departments have enforcement powers as well. h <br /> Mr. Harrington stated that they could tell the BOLI what to do because it <br /> is their by-law. <br /> Mr. Ball asked what would happen if the BOH didn't honor the by-law. <br /> -Mr. Santos started that he had spoken with Ms. Laurent and told her that <br /> there was no reason why she couldn't have cone to the BOH and spoke <br /> to us first before she went to the Selectmen. <br /> IVIS. Carron asked what her response was to that suggestion. <br /> Mr. Santos stated that her reply was that it hadn't occurred to her to <br /> handle it in that manner. <br /> Mr, Ball suggested that she sit in on a meeting when these individuals <br /> request an opportunity to tell their side of the story. <br /> Mr. Harrington stated that they would have to abide by it. He would <br /> recommend that they write to the torn administrator and the selectmen <br /> and say that they would do this, however, it is going to oast the torn <br /> more because they are going to end up in court with a less than <br /> satisfactory result. The other suggestion was that he would like to be <br /> I <br /> notified when something like this is going to be discussed, This was sent <br /> 1 <br />
