He did feel that it should be eliminated within the structures. He then
deferred to Mr. Ball*
Mr. Ball felt that everyone knew what his position was in this matter. He
didn't have any problem banning the smoking in restaurant areas and
bars. He felt that they were the major two issues. He had no problem
banning smoking in the restaurant areas. He did have concerns with
banning smoking in the bar areas especially if there are only sic left in
the town of Mashpee that allow smoking and two of them are 21 and
over. He felt that they should work with the bar owners of the sic bar
areas for people that are 18 and over. They could buy cigarettes at 18,
you are considered an adult at 1 , you can fight a war at 18 but you can't
smoke. You can drink and swear at the bars. You can give people a
choice to go to a bar or not to go. There are probably only 18 bars in
Mashpee. If the bars owners abide by some type of permitting process
that we can make or have to regulate it with a fee. He couldn't see why
we couldn't work with them. The previous board for the last twelve years
have always given the restaurants due consideration. This board has not
even given them an opportunity. That was where he stood. He would like
to at least work with some of the bars, that cater to clients that are 18
years and older in bar areas only, As far as town owned places, it
depended upon the restrictions as far as banning smoking around
buildings. That was his position*
IVIS. Grady stated that her whole background is in public health. It is well
documented that environmental tobacco smoke is terrible for everybody
whether you smoke or not. It Kills over 50,000 people a year. She felt that
they had a responsibility to the public as the BOH to provide everybody
with the opportunity to breathe fresh air. If people decide that they won"t
fake it upon themselves to smoke outside thea that en-fringed upon other
individuals right to fresh air when they were in enclosed buildings. With
that background and with everything that they have as far as studies, she
couldn't do anything accept support a ban in all of the places that they
have mentioned,
Ms, Warden asked the BOH members if theyweren't going to go over the
regulations and try to come up with something.
Mr. Ball replied that they were going to do just that.
Mr, Santos stated that there was no reason to review the regulations
unless they had a vote.
Ms. Warden was under the impression that they had already done that.
i
30
