However, his position remained that they should <br /> have the opportunity and right as a "private party" to have the option to <br /> smoke or not. <br /> Mr. Santos suggested that they mare a motion on this definition. His <br /> suggestion that was under definitions Section E "A separate enclosed <br /> room used for primate functions within a food establishment." <br /> Mr. Ball asked if they couldn't reserve the right of the owner to cone <br /> before the board for a variance. <br /> IIs. Grady stated that that was a correct interpretation of their position <br /> on this definition. <br /> Ir. Ball disagreed with that. <br /> Mr, Santos made it a motion. IVIS. Grady seconded it. They were in favor. <br /> Mr. Ball was opposed. <br /> Mr. Santos had a question mark in regards to the "smoking bar". The <br /> definition was "An establishment whose business was primarily devoted <br /> to the selling of tobacco products for consumption by patrons on the <br /> premises in which the serving of limited foods are incidental to the <br /> consumption of such products." He felt they were speaking of <br /> establishments-such as the Tinderbox. The definition-continues to <br /> include, An establishment that serves full meals is not considered <br /> smoking bar." He felt that that was self-explanatory. An establishment <br /> which serves appetizers and snacks may be considered a smoking bar for <br /> the purpose of this regulation," He knew that at the Tinderbox they don't <br /> serve i . The patrons could bring in their food. They could have a cigar in <br /> the back with a soda. He didn't believe that they have an appetizer <br /> station or any kind of a bar. He was in agreement with this definition as LL <br /> far as letting the patrons smoke in the Tinderbox. <br /> i <br /> Mr. Ball asked if the Tinderbox was open to the public. <br /> IVIS. Grady interjected that the definition did not say that they were <br /> allowing people to smoke in the establishment. If was just giving the <br /> definition. She wasn't sure if that was ghat Mr. Santos felt defined the <br /> Tinderbox situation or not. <br /> IVIr.
