Ms. Warden stated that they took this enact issued to court in Barnstable <br /> and the proprietor lost. That was the wording that they had, she didn't <br /> think they would be challenged. <br /> Mr. Santos suggested that they input another definition for private club. <br /> ls. Grady suggested that they add it on to the list of definitions, <br /> Mr. Santos defined a function room or hall used as for a private social <br /> function. <br /> Mr, Mitrokostas felt that that was no different than a private club. <br /> Mr, Santos felt that they would have to work on that. He felt that the rest <br /> of the regulation was pretty straightforward. <br /> Ms. Warden brought to Mr. Santos attention that the tobacco sales permit <br /> in the regulation i $25.00. The town's current tobacco sales permit was <br /> not $25,00. <br /> IVIS. Grady once again did not know what the fee for the permit was for <br /> the tobacco sales. It would go under the sales regulation that they had in <br /> writing that she was unaware of. <br /> Ms, Warden stated that they could change the fee if they wanted to. <br /> IIT. Grady asked what the fee was. <br /> Ms, Warden replied that it was only $5.00, <br /> Ms, Grady felt that $25.00 was love but $ .00 was ridiculous. <br /> Mr. Ball stated that the state's fee was $5,00. <br /> Ms. harden stated that they didn't have any enforcement so that there <br /> was no reason to raise the fee. <br /> IVIS. Grady asked if they could go through the wording for the sale of <br /> tobacco because she had some concerns about that section. <br /> Mr. Santos reiterated that number two was taken completely out the <br /> regulation ",..The paragraph or this regulation should be interpreted as <br /> prohibiting any town of Mashpee, department or board from suspending <br /> or revoking licenses or permits issued by and within the jurisdiction of <br />
