Mr. Ball stated that it would be up to the board. For example, if Mr.
Ilitrokostas cane in to present the BOH with everything and it would be
the board's decision. Air quality, ventilation, separation, over 18 years old
to go into this place. A smokers' only venue. 1hateveri
[r. Harrington countered by stating that if they get rid of" the BOH is
stating that if they come before the board, once they make the variance,
they will be allowed to have a smoking environment.
Mr. Ball added that that would be provided that they meet the criteria.
Ir. Harrington added that they needed to set some criteria of
ventilation/separation walls. You have to go through the whole gambit.
Mr. Ball suggested that they put "out permitting process" to cover that
area.
Ms. Carron stated that they still would have to define it.
Mr, Harrington felt that that was why Orleans left it to the intent of their
regulation. The intent of their regulation is to protect the public health.
They are leaving it up to the proponent to come up with the criteria to
see if they could meet.
Mr, Santos recommended that they get rid of B", keep the first sentence
of"A", "Any person may request a variance to the smoking prohibition b
application to the BOH." Then they could state, "That variance approval
will not be unreasonably..." Use the rest of the language of"D"a
Mr. Harrington stated that that was standard by state law. They would
have to have one or the other. They couldn't leave it open just to say that
the proponents were going to submit a variance,
!Ills. Warden asked if the board members were going to vote on that item.
Mr. Santos stated that they were in full agreement with it.
IIr. Harrington then asked if there was a motion.
Mr., Santos reiterated that they were all in agreement with that section.
"therefore, they didn"t have a motion.
Mr. Ball stated that this was only a draft.
Mr. Harrington asked them to clarify that they were doing away with B"
3
