Mrs <br /> Harrington stated that he thought it was the town of Orleans that <br /> adopted something. <br /> Ms. Warden advised Ms. Grady that the other board members wanted to <br /> delete B" found under section Xi. <br /> Mr. Ball asked IVIS. Gravy why she wanted to include that section in the <br /> regulation. <br /> Ms. Grady replied that the inclusion of that section into the regulation <br /> was brought about through one of her original conversations with Mr, <br /> Harrington. <br /> Mr. Ball asked Mr. Harrington if he would provide them with an <br /> explanation as to the inclusion of this section in the regulation. <br /> Mr. Harrington stated than Orleans had gone through and looked at each <br /> town's different variances and the options than were given* The one <br /> option that Orleans basically gave was that the variance approval will not <br /> be unreasonably withheld provided that the intent and purpose of this <br /> regulation as declared in section I is not compromised. section I is their <br /> "Findings and Purpose", which basically states that they are there to <br /> protect the public health. They want to stop all effects of second hand <br /> smoke and leave it at that. They don't set any other conditions and leave <br /> i <br /> it totally up to the proponent to what extremes that they will.go through <br /> and have the board determine if whether the conditions that the <br /> proponent presents are in tune with the intent of the regulation. It truly <br /> leaves this interpretation up to the board at that point, other towns have <br /> set some conditions that the proponent may be able to meet, Orleans <br /> didn"t and have basically said that they have to meet the intent of their <br /> regulation and left it at that. <br /> Mr. Ball asked if that "intent" was impossible to meet? <br /> Mr. Harrington stated that that was the question. <br /> i <br /> Mr, Ball felt that that was not fair. <br /> Mr, Harrington felt that if they eliminated "B" they would have to set <br /> some conditions. He felt that they would get into a can of words if they <br /> tried doing that in his opinion. <br />
