i <br /> Ir. Grotzke interrupted and stated that this was a consent orders <br /> Mr. Harrington continued and stated that that was the ultimate order that <br /> got the Bluff lots to be tied in. In that they restricted each of the Bluff lots <br /> to six-bedrooms or whatever the re-configured lots were to six-bedrooms <br /> per lot. Whatever those...all of the lots were very small and they combined <br /> some and shifted some until ultimately they came up with six-bedrooms <br /> per lot, which was a restriction. What the BOH did, some of the septic <br /> systems9 because of the variances, actually limited the properties to <br /> lower amounts of bedrooms. There was one study per twenty-three or <br /> twenty-five that they had to leave open until it gets connected to the <br /> sewers, That would have been a seven so-called bedroom because it had <br /> closed off doors. They-have been holding them to the six. Right now the <br /> variances that have been approved where the reserve area and some of <br /> the sideline issues. He didn't believe that the other ones dealt with the <br /> BVW or those other type...he didn't think that 23 or 25, those are the only <br /> two that he had dealt with since he has been here and those were already <br /> started when he care. He didn't think that those lots had wetland issues <br /> with therm. There were up high and basically in the middle of the bluff. <br /> (Mr. Grotz a responds to this line of discussion but it is difficult to <br /> understand his response.) He continues by stating that originally they had <br /> planned on having a bigger house and they had placed the system here <br /> (He points to the plan.) practically in the coastal dune. He wouldn't expect <br /> that they would get approval for putting the system up there today either. <br /> He admitted that it was a difficult situation. <br /> Mr. Harrington stated that he didn't ultimately believe that these deed <br /> 4 restrictions were even valid. The reason being Mr. Harrington states that <br /> he is going to quote from the permit at this point.) "That as long as this lot <br /> is serviced by the on-site sewerage disposal system shown on this <br /> permit." so if they were not going to use this septic system that was <br /> approved for this permit. Mr. Grotzke was now presenting a totally <br /> different proposal. <br /> Mr. Grotzke responded that there was also a "Tillage Declaration" that <br /> was recorded at land court, which also limits each of these lots to a <br /> specific number of bedrooms. It is very consistent. This one is actually <br /> restricted to six in the village declaration. Most of therm are actually <br /> restricted by the village declaration to four except for the double lots, <br /> which are six. <br /> Mr. Harrington understood and added that numbers 23 and 25 were the <br /> other double lots, Those are the ones that he had dealt with. <br />
