T
Title V documents. it has nothing to do with the selectmen.
Ms. Marden stated that the document has a signature page for the board
of selectmen to sign. Ms. Warden stated that they had to sign the
document because the town was donating the land.
Mr. Dickinson added that it was his understanding that it was only the
selectmen could give away rights on their land.
Ms. Carron added that people who owned the land had completed all of
the ether land aggregation.
(the board reviewed the plans and documents for both lots.)
Ir. Santos asked Mr. Harrington if he wanted the board members to okay
his final review and approval of the septic application.
Mr, Harrington stated that he didn't want the board to do that. He felt that
the Habitat for Humanity had done everything that they needed to do for
the land aggregation and septic designs. However, they now needed to
forward all of the documents to DEP. He didn't think there should be any
problems with the current septic design plans as presented.
Mr. Santos stated that there are no variances. The board solely wanted a
clarification of the land credit for those homes.
IIIb. Harrington stated that they had clone that. DEP will receive a cop] of
the approval letter for the Title V plans, the credit land restriction plan
and the deed restrictions. That way the DEP will know that they had
approved all of those documentations. He added that the reason why they
held off on other properties was because the other properties weren't
purchased until the approval was done. They actually had to hold off until
they got the approvals. The DEP letters even stated that they were in
substantial compliance. The DEP wouldn't even say that they granted full
approval because the people didn't own the lots yet. They had to wait
until they got approval. The properties could be sold and they were
recorded when they were transferred. In this case, they were using the
same part of the code but under a different use for the town as the
grantor.
Mr. Santos made a motion to approve the plans as submitted for 29 and 35
Sandy pox Drive and the grant of"Title 1 restriction and easement as
delineated on plans submitted by canal Land Surveying 00152elated
December 51hq 2002. Ills. Grady seconded the motion. Motion passed*
5
