of the structural integrity. They stated that it was a conditional pass. The <br /> property was transferred in July of 2001. Essentially that June of 1999 <br /> was no long valid as it was beyond two years. He questions the validity of <br /> the transfer itself. Again, he didn't know the exact date of transfer. He <br /> was just being told that it was in July, which is beyond the two years. <br /> Mr. Snow was present and he noted that the exact dates could be <br /> referenced under footnote number one. <br /> Mr, Harrington continued that on July 26 t" 2002, the board became aware <br /> of the situation. Then on August 12th1 2002, IVIr. Harrington went out to do <br /> an on-site. He then proposed a meeting with Mr. Snow and a contractor. <br /> He was late to the appointment and missed them. He stili went to the <br /> property and looked at the tank with the overflow cesspool. He saw <br /> evidence of it caving in. He concurred with the inspector at that point. <br /> Mr., Snow agreed that the system needed to be re-placed. There was no <br /> question about it. <br /> Mr. Harrington stated that the BOH reviewed and approved an emergency <br /> repair on September 5th9 2002. Unfortunately, that emergency certification <br /> did not get sent out. But, the board did review and approve it at that time. <br /> They did not require engineering plans per his recommendation. He had a <br /> conversation with Mr. Snow in November. Mr,. Snow requested an <br /> extension until the first week in December because the contractor that he <br /> was dealing with did net give hien any type of service. Mr. Harrington <br /> agreed to give him another week or two weeks since it wasn't going to <br /> hurt anything at this point. Since he was hawing someone one to come in <br /> and do the work or give him a bid. At the turn of the year, Ms. Warden <br /> went through the draw that had all of the failed inspections in it and <br /> subsequently cane across this property because it was in that draw as it <br /> was a two-year old plus septic inspection, A letter went out to Mr. Snow <br /> starting that he had to fix the system within a certain amount of time. That <br /> is why they are here now as a result of that letter and Mr. Snoves request <br /> and not to meet the engineering requirements. <br /> IVIS. Warden added that there was a need for engineering plans for <br /> something she had forgotten wham it was. <br /> IVIr. Harrington interjected that there was a transfer variance. <br /> Ms. Warden disagreed and stated that it was an easement or an ancient <br /> way, <br /> Mr. Harrington disagreed and stated that it was open space. He looked it <br /> 22 <br />
