5` 1 TOWN of MA HPEE BOARD of HEALTH March 1 1", 2003 THE TAPE IS NOT PAIN of THE MEETING: IT Is FOR THE PURPOSE of TRANSCRIPTION ONLY. Board Members Present: L. Glenn Santos, Steven R. Ball, Glen E. Harrington The meeting began at :1 PM: NEW BUSINESS 1, sign Warrants. Warrants signed. 2. Approve the minutes of December 'I'I 1" 2003 and January 9th 2003 There wasn't a full board therefore they continued the approval until the next meeting. . Smoking Regulation - Request to delay effective date of new smokin regulation: Mr. Ball asked Mr. Santos if they should address this topic without IIT. Grady being present for the meeting. IIIb. Santos asked Mr. Ball how he felt about the situation. Mr. Ball responded that he felt much like anyone else that carne in and asked for extensions or variances. It would be admirable to extend this request that he is making because they have had a bad winter business- wise and it would fall in lime with Falmouth's course of action. He didn't believe that it would hurt anything. It was all said and done on January 15t, 2004. Falmouth has done it. If they don't and April V1, 2003, continues to be the deadline, then they have been given plenty of notice. Their complaint is going to be that the business is going to go to Falmouth where they can smoke. Why not extend it The board has always worked with people. Not just the restaurant owners but Deer crossing and I lashpee commons to extend different permits and requests over the deadlines. They have always done that and he didn't see any harm in this. It also gives this board and the agents a little more leeway to fine tune the outside smoking regulation, which is kind of a little sloppy. That needs to be fine-tuned. What can they and can't they do It just gives therm a little more time and the whole cape is done. IIIb. Santos felt that what Falmouth is doing, in his opinion, has nothing to do with the Town of Mashpee. They have given everybody more than
