i
H
that the Mashpee board patterned their regulation on the Barnstable .
regulation. The question in his mind, from a legal viewpoints was whether
or not the regulation covered this establishment. It was not like "Puff the
Magic", which was a bar that allowed smokings It was not a bar and no
food was served. It was just a cigar store with a smoking room.
Mr, Santos interjected that they did have a retail food service.
Mr. Stanton added that it was not for consumption on the premises. It was
some olives.
Mr. Santos felt that other food establishments would think that they were
treading a fine line with this argument.
-x Mr. Stanton asked the board members that if they got grid of the olives and
didn't have to obtain the food service license would that make a
a
difference.
Mr, Ball stated that the board members should know homer he feels about
this matter anywayse
r Mr. Harrington felt that the definition would still cover there.
Mr. Stanton asked Mr. Harrington,) which definition he ryas referring to.
a
Mr, Harrington responded that it would fall under the "smoking bar"*
Mr. Stanton and Ms. Geigel, owner, both responded that the establishment
was not a bar.
Mr. Harrington understood that it was not a bar.
+_
Mr. Stanton asked what the definition of a smoking bar was, That was his
question, ultimately, if you look at the Barnstable regulations they refer to
a smoking bar a place like "Puff the Magic", which this place is not.
Mr. Harrington replied that the primary purpose of the establishment is to
self tobacco products. Appetizers may be seared, peanuts, whether they
are potentially hazardous or non-potentially hazardous. The food that is
served can be appetizers only. It does not refer to a liquor license or
consumption. it just includes appetizers only. It was not considered a full .
-• 5
service where full meals are prepared,
IIIb. Stanton re-iterated that no food was served at this establishment.
e a
.i , .i ,yfy-HTiMM•►A•1•►'•C• -•yM r- ,.n+uaiA. w51r•MIaSCY'"}'+y?'/•M4YiaypM4`.a
