To allow this they would be <br /> granting a variance that was grossly out of compliance. They tried to do <br /> this with Mrs,, Barr down at Maushop in New seabury. This was where <br /> Bortolotti had put the leaching out in the road. Again, this was something <br /> that the board couldn't grant a variance to because it was grossly out of <br /> compliance with Title V. This comes down again to the board being more <br /> stringent than the state code. This is something that the board can't be <br /> involved ins <br /> Miry Golub asked why it was out of compliance. <br /> Mr. Ball responded that they newer carne to the board for a variance, <br /> Mr. Harrington continued that the setback to a slab is ten-feet for the <br /> leaching pit. <br /> Mr. Golub Mated that because it was under the slab it had to be ten-foot <br /> from the slab. He asked them if they couldn't issue a variance for this <br /> situation, <br /> Mr. Harrington replied that he could issue a variance to the slab. But, <br /> there are typically conditions that have to be set to meet equal <br /> environmental protection, which is one of the other.., <br /> Mr, Ball interjected that they would be opening a can of worms for anyone <br /> else that carne in with a similar situation. He felt that the only option was <br /> to see if it was an H20, If it is then wre"ll go with the plan for accessing the <br /> pit. if It is not then the only other option is to put in a leaching field. Their <br /> hands were kind of tied on this thing. <br /> Mr. Golub confirmed that if it is an H2O then they could get away with if. <br /> But, Mr. Ball said that if it was an H10 thea it wouldn't be a problem <br /> because there would not be a lot of traffic, <br /> Ills. Warden re-iterated that it was the variance. They couldn't issue a <br /> variance on the H10, it just automatically fails because it was under the <br /> slab. <br /> Mr. Golub asked if the H2O could be under the slab. <br /> Ms, Warden responded that they could have a surface with a metal cover. <br />
