The structure for the establishment of the board of health <br /> was to eliminate it from the governing hand of the selectmen. He needed <br /> to read one thing to the board. Where there is the provision for there being <br /> a beard of health* There was also according law a town charter can b <br /> brought in where the town charter does oversee the administration of the <br /> board of health and the other boards. Doing it by charter is a legal foam of <br /> the law. He was not saying that it was better. He didn't Know if it was <br /> better. He would like to discuss it with Mr. Thomas Mcl+ een, his former <br /> boss to see what his feelings were in this matter. He might speak with <br /> some of the ether members in Barnstable because they were under a <br /> charter. He was of the opinion that he would not like to see the board as <br /> part of the selectmen. He felt it was up to the people to elect the <br /> members on how he or she perceive the public health be handled in the <br /> town and not ultimately by the group of selectmen who may have no basis <br /> or knowledge or public health or who to put in the position. <br /> Mr, Santos asked for clarification of whether or not the board of health <br /> answered to the charter commission. <br /> Mr. Harrington stated that they did not. He added that the members could <br /> be appointed and removed under the charter. The charter would <br /> ultimately put the selectmen In a position of administrative power over <br /> the board, The board of health would still maintain all of the <br /> administration and enforcement of the MGL, the regulations and the local <br /> board of health regulations. They would have no right to influence any <br /> poorer over that. <br /> Mr. Ball interjected that they would be autonomous. <br /> Mr. Harrington agreed and added that the board of selectmen would still <br /> have the right to remove you by charter. But, they couldn't remove you <br /> because of your board of health decisions. They would have to show <br /> cause. He could read thein the list of reasons for cause. <br /> Mr. Santos stated that his first concern was that when he first became <br /> aware of the situation in the enterprise. They wanted to have three boards <br /> appointed and not elected. The first thing that carne into his mind was <br /> that a few years ago with the DPW and the selectmen. They discussed the <br /> changing over of the transfer station. Then board member, .John Doherty, <br /> had a very good point. That this town as small as it is, no ratter what <br /> board you on and what position you holdq there was still going to be a <br /> potential conflict of interest somewhere along the line for every board <br /> member on even decision being made.
