Grady asked if somebody was going to be here regarding this agenda <br /> item. <br /> Mr. Harrington responded that he had spoken to Dana Hill on this matter. <br /> He was the contact for DEP. The time has passed for the DEP to comment, <br /> They had to issue the permit last Friday because their time was up. They <br /> had a question regarding what the current design flows were for the <br /> buildings, Dight now, they were going to let that go because their time <br /> had run out. That was it, When Mr. Hill called him just a couple of days <br /> ago. He had a problem with where this actually falls into their approval <br /> process. This was not a general, provisional or remedial approval. But, it <br /> sterns from a town regulation. The systems are failed and it was not new <br /> construction. It was not considered a sub-standard system. It merely <br /> sterns from a BOH regulation requesting additional nitrogen removal on <br /> large level systems, which the board considers to be 600 GPD or over, so <br /> because it didn't fall into any nice little box for them he was all concerned <br /> as to what approval he should give it. Mr. Hill didn't have an answer for <br /> that. Mr. Harrington told him that by home rule the BOH has the right to <br /> make stricter regulations as Long as it was stricter than the Mate <br /> regulations. He asked why it was stricter than the state regulation. He <br /> said that that was what the board did and it was in line with the intent of <br /> the law. That was the answer Mr. Hill was looking for. But, Mr. Harrington <br /> didn't think it was his ultimate answer. But, that was the answer that he <br /> got. Now Mr. Hill granted a meeting next Tuesday in Boston with Holmes <br /> McGrath and somebody from the office. He just got this request this <br /> afternoon. He didn't know what the meeting was going to be about. <br /> Ms. Grady asked if Mr. Harrington was intending to go up to Boston. <br /> Mr. Harrington replied that he was going to try to get out of it in every <br /> possible moray# He wasn't going up to Boston for this. This was something <br /> that needed to be dome. He wasn't going to waste a full morning to go up <br /> there for this because it doesn't fit in their fancy little box. <br /> Ms. Warden added that there was nothing to explain. They have a <br /> regulation and this was a requirement. she wasn't sure ghat the DEP <br /> angle was in this matters <br /> Mr. Santos stated that if they were going to issue a permit then there was <br /> no reason for the rest of this stuff. <br /> Mr. Harrington agreed But, he had yet to receive a copy of it yet.
