But, now <br /> they have documented it above drinking water levels. so they had to take <br /> action, as the board should fee. <br /> Mr. Ball and Mr. Harrington felt that they should sand the notice to <br /> everyone regardless of whether they were domestic or irrigation wells. <br /> 7, charter Commission: <br /> Mr. Harrington stated that the Massachusetts Association of Health <br /> Boards was setting up a conference call for board members for those <br /> towns that were having proposed charters. The call was to discuss the <br /> pros and cons of Laving the charter in torn and it's effects on the board <br /> of health. He just wanted to make the hoard members aware that they <br /> should probably get scheduled to sit in on this conference call with any <br /> questions. <br /> Mr. Ball asked if they knew exactly when the date and time would be. <br /> Mr. Harrington responded that he did not know what the date and time <br /> was for this matter. He felt that they were waiting for people to call <br /> back. <br /> The board members discussed a good day for this call. They agreed upon <br /> Tuesday, March 2 nd9 2004. <br /> OLD BUSINESS <br /> A. Great Flay Acres - Nitrogen Aggregation Loading Plan <br /> Mr. Harrington advised the board members that they had heard back from <br /> town counsel and he had notified the attorney for Mr. Weinstein. The <br /> attorney called back this afternoon requesting an extension to the next <br /> meeting.. They were not prepared to come back before the board because <br /> they had just found the information out the other day and wanted more <br /> time. <br /> Mr. Ball asked what town counsel's opinion was on the matter. <br /> Mr. Harrington responded that torn counsel's opinion retained the same <br /> ars it was in 1999 when they issued their first opinion. Mr, Weinstein had <br /> to go a tern meeting and get town meeting approval with a tiro-thirds <br /> vote from the legislature because it was conservation land. The part was <br /> that they were proposing an attachment from the basis of the special <br /> permit because they were affected by it. They felt that they had the right <br /> to use the credit land and open space is credit land. Town counsel's <br /> response that the special permit was issued by the planning board.
