4 <br /> ` ` s <br /> 4 They were not really in a position where they thought that they were libel <br /> on any grounds for the $38,000.00 fine for the order. In reading through <br /> the orders and reading through the regulations along with the research <br /> that she had done, she believed that they complied 100% with the order <br /> to do the repair work. she brought copies of it and if they read the plain <br /> language of it. It said that they were ordered to...basialiy she <br /> highlighted the section...August 1 ltl2003, and what was at issue right <br /> now was order number five. What they were asked to do in the order was <br /> to retain services of the licensed septic system installer to make the <br /> necessary repairs to soil absorption system within fourteen days. <br /> "Necessary repairs" and "emergency repairs" in the same <br /> Massachusetts...one you have -days and they did do it within 14-days <br /> because it was an order. From their records they had A & B canco out <br /> there. They snaked, cleaned and pumped the septic system on the <br /> 1 t".on the thirteen and fourteenth they completely cleaned out the <br /> septic system, The next week Mid-state Sewer subcontracted with A <br /> canco and by the 18th they had excavated around the septic system. <br /> They had excavated the two tanks, put in a manhole and removed the <br /> plug that was in place. In reading through the 10.05 regulations that she <br /> has... <br /> Mr. Ball asked her to confine the I 1" of what month. <br /> Ids. Gromelski replied that it was the 18 1n of August. They carne and did <br /> all of the emergency repairs. Anything beyond emergency repairs under <br /> 'title V require that it become a new system and that wouldn't constitute <br /> repairs. Anything beyond pumping and actually leaking a new <br /> system...When they had the inspection cone out they determined that a <br /> new system was needed., By the Title V they were entitled up to two <br /> years to put it in unless ordered differently. In no order did it say that <br /> new system needed to be installed. The first notice that they hard-of any <br /> new system being installed was the letter from the board meeting on <br /> January 1thj 2004, when they actually did set out when the system was <br /> to be installed, They were attempting to comply with it. Jeff had been <br /> working really hard and all of the guys were under the impression that <br /> they were doing everything that they needed to do to get the system up <br /> to where they needed to be. if the board had issued-an order and actually <br /> sent them a letter telling Neem explaining to there when and setting a <br /> timeline for the repairs they would have been done in the fall rather than <br /> dome now, The only re son...1 mean we're doing them because we're <br /> following your...H had already hind Bohler* They were working on a new <br /> system replacement* They were working off of the Title V regulations, <br /> which says that they had up to two years to institute it unless ordered <br /> differently by the local board, <br /> i <br />
