}
S
f
t
Mr. Santos interjected that her interpretation of this law was applied
when the system was inspected and it had failed or there was a change
of ownership.
IVIS, Gromelski interjects and says Hilo."
Mr. Santos continued by stating that if it was an emergency failure,
which it was because it was bubbling out of the ground and the
bathrooms were closed. Furthermore, the health agent was told by an
employee of Mobil was that they couldn't flush the toilets because it
carne bubbling out of the ground. That was why the beard members tool
it as seriously as they did and make it an emergency repair. It was an
iap
mminent health hazard. Mr. Santos wanted to make sure that she was
clear on that point and their in January when they cane in after a lot of
certified rail. IVIr.. Harrington, no doubt, had a lot more records than he
did regarding the time line. But, these gentlemen carne in front of the
board and said okay we have a problem and this was what they were
going to do. They were going to put a new system in and it would be
sometime in the spring. That was when the board said no it was not
going to wait until the spring. His first statement was, he felt that
everyone would concur with him, were they prepared to pay $300.00 per
day until spring. They basically notified thein back in the fall with
certified mail that it was a serious health hazard. It was bubbling out of
i
the ground and they did some repairs. But, there were still issues and
still problems with the system. Correct him if he was wrong and now
suddenly he is conning to a meeting to talk to the board. They've hired
this engineering firm and he felt that they were finally moving the right
direction. But, why did it tie so long to cone in front of them. They
could all have been in front of the board in August or September, That
was his statement back in .January. They were a very flexible board and
they were will to.work with anybody. If there-had been a problem or they
didn't want to rip up the ground in August, could they wait until October? .
He didn't even known if Niro Harrington had received a pumping schedule
that they asked for back in January.
Mr. Harrington interjected that they did not have a pumping contract,
i
Mr. Santos continued that they only-got the pumping of the tight tank for
the car wash. where the septic system was in failure it needed to be
pumped on a consistent basis. They did not even have that
documentation, He was not trying to read her a riot act. But, he wanted
to make sure they were all on the same page. This was the xray he
understood the situation to be and that was why they acted the way they
did.
6
