His beef was with the DEP. <br /> Mr. Ball stated that the board could require him to get the denitrification <br /> systems in within six-months. <br /> Mr, Harrington agreed and added that the board could still make the <br /> requirement and start fining hiM and take hire to court for being out of <br /> compliance with their regulation <br /> Mr. Santos,added that as far as the board was concerned. Mr. <br /> r <br /> Hajjar was trying to get the pilot system through the DEP, which raised up <br /> all of the flags. He could now go back and fight the DEP for each <br /> individual building. The DEP would.be happy and the board would b <br /> happy, It was up to Holmes & McGrath and Mr. Hajjar to do all of that <br /> negotiating and fighting. <br /> Mr,, Ball felt that they should give him six-months to put the denitrification <br /> systems In the ground. The rest of the problem was up to Mr. Hajjar-and <br /> Mr. Mc rath'to work out with the DEP. <br /> Mr, Harrington interjected that they needed to understand that the board <br /> might not be without any culpability here as far as the previous decisions <br /> that were made. They would tete it on at that time, <br /> Mr. Santos felt that the damage was already done. The DEP was aware of <br /> what the flows currently are and what was permitted and ghat wasn't. If- <br /> they were going to come down on the board they would have already done <br /> it. <br /> Mr. Harrington disagreed. He felt that the DEP would have to go through <br /> its process before they addressed the board. Mr. Dudley knew about some <br /> of the past permitting problems that had occurred here as far as some of <br /> the restaurants. He wouldnOt say that the DEP would totally tura us off as <br /> far as working with the board and Mr, Hajjar. But, it had to be done <br /> through the groundwater discharge permit process. They couldn't hold Mr. <br /> Hajjar up from doing that when the DEP had.orders against hire too. If he <br /> wanted to start litigation, fine. But, he still needed to get into the <br /> groundwater discharge processor If would be out of the board's hands, but <br /> they would have some input. He thought they would entertain it. They <br />
