T <br /> i <br /> Mr. Santos noted that he had another Sappointment Pl. <br /> . review roval of'Pro osed Se tic Inspection Regulation, <br /> Mr. Harrington noted that this was posted the previous two Fridays in the <br /> Mashpee Enterprise for this new supplemental regulation for septic <br /> inspections. There were several gray areas that needed to be clarified in <br /> Title V. There were also people mere to discuss this topic, Wherefore, they <br /> definitely needed to ask for public comment. There were certain policies <br /> that were written before the board that were never made into regulations <br /> so they didn't have the full enforcement of the board of health. Granted <br /> they were fine for guidelines. But, when it carne right down to having an <br /> owner repair system or having the exact failure criteria set in stone <br /> beyond Title V., It really needed to clarified. `there were no timelines for <br /> conditional passed. When a property sells and it was a straight failure <br /> they would have two years to fix* If it was a conditional pass or if it was a <br /> further evaluation by the board of health. There was no end date on it, It <br /> could just go on and an without any repairs made to the system or any <br /> final evaluation being made by the board of health. It didn't.really help the <br /> buyer any and things were left in limbo for the sale of the property. H <br /> was going to try to clarify some of those things within the regulation. One <br /> thing also, the first part of this was a registration component where they <br /> have the septic inspectors register within the town. That also put the <br /> enforcement of the inspectors to make sure that they were not acting or <br /> reporting things fraudulently or incompletely. That would give the town <br /> the actual policing power, tight now it was a state certification. The <br /> state historically had not issued any fines or enforcement against <br /> inspectors that were not doing their jobs. They were trying to make it a <br /> level playing field by telling the inspectors what the town expected of <br /> therm. The state wasn't redly doing anything when it cane down to <br /> enforcement. He had been involved with several cases that weren't <br /> complete and there was no enforcement of the individuals,, He felt that <br /> they could bring it down to a local level where it should be. <br /> Ms. Grady asked her fellow board members if they wanted to entertain the <br /> local comment first or discuss it themselves. <br /> IIIb. Harrington asked if they wanted to go through each part of it to <br /> address any questions they might have regarding the regulation. They <br /> could certainly address that gray. <br /> (The tape enols and the discussion continued.) <br /> Ms. Warden states that IIIb. Ball had brought up a valid point, she felt that <br /> although it showed a certain amount of stone on a plain, without a plan on <br /> file there were potential problems, This part of the regulation was more <br /> i <br /> i <br />
