i
w
Mr. Harrington stated that Mr. McGrath was saying that it would affect the leaching
because right now this was a retrofit leaving the existing leaching pit. But, Mr.
McGrath was saying that the DEP considered any other additional seats to this and
he didn't agree with that as far as the way he had the flows figured before. For what
the other flows within the building was for with the barber along with the retail and
office worked out.that they could have the 70 seats and not the 5 8. He didn't know
why the DEP was considering that other than opening up the entire reserve area after
1995 deadline. That was another whole issue too.
i
Mr. McGrath that the EP's attitude was that it could not have with the reserve area.
The other issue was how they could do that when they knew that over 2000 GPD
you have to pressure dose. This would all have to be pressure dosed in today's
interpretation. Perhaps in 1995 they would have had a different interpretation. They
all knew that Boston gave different answers to different people. He had tried his
damndest to get these systems in the Bound.
Ms'. Grady asked what they could do tonight.
Mr. McGrath stated that he would meet with Mr. Harrington. But, he didn't know
what he could do. He would come back one more time. Perhaps, he could meet with
hire and report to the board and then he could send a letter.
Mr. Santos stated that he had no problems with the plans. He was sick and tired of
beating this horse. The concern that he had was that wanted the board to be in the
middle ofthis mess. He could certainly appreciate this. The last thing he wanted t
happen was for therm to vote for the 58 seats, the barber gets three and there was
ongoing litigation. He wanted a clarification from Mr. Hajjar or from the legal that
the restaurant owners and the barbershop were in agreement with the septic plans as
presented. If they would send a letter to the hoard or correspondence to him. That
was his only sticking point. He could see this coming back and bite them on the butt.
There was a letter-in the file that-lie sera a letter on August 2P, 2004, that the
Mashpee board of health had already approved the reduced flows. They were having
that meeting now. weren't they?
Mr. McGrath responded and stated that if that was wrong he would correct it with
the DEP. If, Mr. Santos felt that that was wrong he would be sure to send thein a
letter. He did not sign it. His partner signed it.
Mr. Santos re-iterated that as far as he knew they never approved that. The board
had never agreed to that.
Mr. McGrath agreed with Mr. Santos that they never approved that point.
Mr. Santos stated that was only position in this matter.
i
Mr. Harrington stated that that was fine. He would like to sit down and figure
something out.
1
