1 ' <br /> M <br /> ti <br /> TOWN OF MASHPEE <br /> BOARD OF HEALTH .-- PUBLIC M <br /> Minutes of the Meeting of Thursday, October 6, 2005 <br /> Board Members Present: , Also Attending: <br /> Glenn Santos, Chairman Glen Harrington, Health Agent <br /> Lucy Burton, Cleric Veronica Warden,Assistant Health Agent <br /> Board Members Absent: <br /> Steven Ball, Co-Chairman <br /> Chairman Glenn Santos called the meeting to order at 7:12 PM. <br /> APPOINTMENTS <br /> TS <br /> Bradford Sweet, 133 surnmersea Road—Title V Variance Request <br /> Bradford Sweet introduced himself to the Board. He stated that his house at 133 Surnmer ea Rd. has <br /> been on the market for quite some time. Brad had the Title inspection at the time he put the house ori <br /> the market et and thought he had met the re uirements. Since then,there has been a change in the <br /> requirement, to bring the D-Box up to the surface. Brad Mated that in order to do this, it would be <br /> necessary to dig up the asphalt driveway and disturb the lawn in the front of his property. Brad stated <br /> that this is a problematic time to do this. He is eager to sell the property at 133 Bummersea Fid because <br /> he has already moved into another home in Mashpee and is struggling with two homes. To dig up the <br /> driveway and disturb the lawn will create a serious drawback in his effort to sell the Surr mer ea house. <br /> Glen Harrington stated that the D Boy needs to be ars H20, not an H 10, and suggested that the inspector <br /> be asked to return to do an inspection by a remote camera, in order to avoid disturbing the driveway. <br /> 5 . <br /> Glean Santos moved that the variance request for 133 Summersea Road, as stated in the Variance <br /> Request Form SnUbmitted by Brad Sweet, be approved,with the stipulation that Bortolottl be required t <br /> return to 133 summ rs a Rd.to do an inspection of the D Boy located under the driveway, using a <br /> remote camera. Lucy Burton seconded the motion. All approved. <br /> Waste Management—Show cause Hearing--UC TS Noncompliance <br /> Marti Healy, attorney with Goodwin, Procter on behalf of Waste Management, Gail Lynch} House <br /> Counsel for Waste l ana ernent, and Paul Pengeroch, General Manager, introduced themselves to the <br /> Board. <br /> Glenn Santos started that the BOH is receiving conflicting information about the legality of the Mashpee <br /> hpee <br /> regulation regarding use of the kipper cape Regional Transfer Station. The BOH needs to get further <br /> clari%cation and advice from Town Counsel regarding authority of the Mashpee regulation. <br /> Glean Santos further Mated} however, that Waste Management was mare of the Mashp a regulation <br /> when they signed the contract with Mashpee, but have riot, in fact, been hauling Mashpee trash to the <br /> Upper cape Regional Transfer Station. <br /> Martin Healy pointed out that the Mashpee regulations were not referenced in the application or the <br /> permit which Waste Management signed. Martin offered to share his research into the issue, and stated <br /> that 1laste Management wants to work together with Mashpee to resolve the issue. <br /> Glenn Santos made a motion to continue the case until further cladfication and advice can be obtained <br /> from Town Counsel. Lucy Burton seconded the motion. All approved. <br />
