Y <br /> i <br /> ' I <br /> l TOWN OF M <br /> BOARD of HEALTH - PUBLIC MEETING <br /> Minutes of the Meeting of Thursday, October 20, 2006 <br /> Board Attendees: Also Present: <br /> Glenn Santos, Chairman Glen Harrington, Health Agent <br /> Lucy Burton, Clerk Veronica Warden, Assistant Health Agent <br /> Absent: <br /> Steven Ball, Vice Chairman . <br /> Chairman Glean Santos called the meeting to order at 7:05 PM. <br /> APPOINTMENTS <br /> Evelyn Fernandes—9 Seconsett Point Road -"Show cause"' Hearing <br /> Glen Harrington reported on the receipt of a letter from Laura Fitzgerald, Counsel representing Gary Fernandes <br /> who is the administrator of the estate of his late brother Donald, and Evelyn Fernandes, their mother,who is heir <br /> to the property. The letter is in answer to the order to Donald and Evelyn to appear at a"show cause" hearing <br /> before the BOH on October 20, 2005. Ms. Fitzgerald's letter explains that Gary and Evelyn Fernandez are <br /> wafting to receive records of the estate from the Town concerning the property in order to address the Town's <br /> concerns about the septic system. Gary Fernandes now resides in Nevada, and Evelyn is quite elderly. The <br /> letter further stated that the property is currently vacant. Laura Fitzgerald is requesting that she be allowed to <br /> represent Gary and Evelyn at the next BOH meeting, and asked for a continuation of the"Show Cause" hearing <br /> until November 10, 2005. The Board agreed that the next BCH meeting would be held on November ber , 20051 <br /> and would continue the Fernandez"Show Cause" hearing until that time. <br /> Waste Management—Non-Compliance,solid Waste Haulers Reg.—continued from 10106105 <br /> Continued to the 11/03/05 BOH meeting. <br /> OLD BUSINESS <br /> 333 Monornoscoy Fuad—continued from 9108105 Fleeting <br /> At the September 3t' 2005 BOH meeting, Glen explained the situation at 333 I lonornos oy Road. The owner, <br /> 1r. Hynds, has a two-bedroom garaige,'and plans to build a four bedroom house, plus add another bedroom in <br /> the barn. With 7 bedrooms on the property, a 1.0 Fast septic system is required by the BOH regulations. The <br /> owner had Inst [led an o.5 denite system two years ago on the property at a cost.of$4000, and was hoping for <br /> a variance approval from the required 1.0 Fast septic, citing the installation cost of$11,000 as a financial <br /> hardship. Since Mr. Hynds had not formally requested a variance at the tirne of the sept 8th meeting, the Board <br /> could not approve or deny such a request. Instead, the Board approved a motion to continue Mr. Hynds'formal <br /> application for seven bedrooms on the property, with the recommendation that Mr. Hynds refile, pu#ting all of the <br /> bedroom flog through the dernite system, forcing Mr. Hynds to install a 1.0 Fast system. <br /> Since Mr.Hynds has not yet refiled a septic variance request, Glenn Harrington recommended that the Board <br /> deny the original application so that when a new filing comes in, the Board can start again. <br /> Glenn Santos made a motion to rescind the motion passed by the BOH on 9/08/05, which approved a request <br /> for continuance of Mr. Hynds'formal application for seven bedrooms at 333 Monomoscoy Load. <br /> Lucy Burton seconded the motion. All approved. <br /> Lucy Burton made a motion to add a discussion of 29 Devonshire Drive to the meeting agenda. Glean Santos <br /> seconded the motion. All approved. <br /> 1 <br />
