McDuffy <br /> Glen Harrington reviewed the situation, stating that the BOH had posted a warning notice on the property on <br /> August 25, 2005, regarding the requirement for town water hookup for the property.- On Sept. 19, 2005, <br /> certified later was sent to Mr. I cDuffy ordering him to appear at the 10106!05 BOH meeting for a hearing. On <br /> Sept. 24, 2005, the Board sent a certified letter of non-compliance to Mr. M Duff . Since Mr. McDuffy did not <br /> appear at the-BOH meeting on 10106105, the Board approved fines of 50 per day, effective 10107105, until the <br /> town grater hookup is completed. <br /> Mr. McDuffy called Glen Harrington today to request that the fines be discontinued as of 10120105. Mr. I icDuffy <br /> stated that he had gone to the Water District and requested the Water District to complete the hookup to his <br /> property, and he paid the 1200 betterment to the!hater District. Mr. I I Duffy felt he should not be required to <br /> pay the$50 per day fine beyond 10120105, since he hes paid the betterment fee. <br /> Glenn Santos made a motion that the Board deny Mr. MeDuffy's request to stop the fines as of today, 10120105, <br /> and to continue the fines until the water hookup is completed. Lucy Burton seconded the motion. All approved. <br /> Septic Inspection Report rt—26 Little Nock Lane(continued from 10106105 Meeting) <br /> John SIavinsl y of Cape&Islands Engineering introduced himself to the Board. <br /> Glen Harrington gave tete background for the property at 26 Little Neck Lane. A septic inspection on the <br /> property had been done by John Graci who identified two cesspools one of which is in;the driveway, and the <br /> other on the edge of the driveway. The cap and inside lip on the-cesspool in the driveway are cracked. The <br /> other cesspool appears to be structurally sound. The issue is that the cesspools do not meet the Tine <br /> standard as far as having no less than a 50 foot setback from the saltwater marsh. The bottom of the coastal <br /> bark where the salt marsh begins is just 30 feet from the cesspools. However, the cesspools are still operating, <br /> and cesspools can be evaluated under Tide V inspection. <br /> Lucy Burton stated that in her opinion, the septic system at 26 Little-Neck Lane ils failing to protect the <br /> environment and the public health safety.. Glenn Santos agreed with her assessment. <br /> Lucy Burton made a motion that the Board vote to fail the septic system and require that engineering drawings <br /> be done. Because the system is less than 75 feet from the salt marsh, it will require denite and ultraviolet. <br /> Glean Santos seconded the motion. All approved. <br /> NEW BUSINESS <br /> Sign warrants. Warrants were signed by the Board members. <br /> -Approval of Minutes of 8105105,91081059 9122105. Approval of these minutes was continued until the next <br /> Board meeting when all board members are present. <br /> Glenn Santos made a motion to place on the agenda the approval of minutes from the BOH Public Meeting held <br /> n 10106106. All approved. <br /> Request for Further Evaluation—septic inspection Regulation,,n, 5 sunset circle <br /> Glen Harrington stated that during a septic inspection perfbrmed on 9/16105 by John Graci, it was determined <br /> d <br /> that this property has a septic system with the leaching pit.'1 foot above ground water. In accordance with BOH <br /> septic inspection regulations, the inspector is to identify violations of the and 95 codes, thea place it under <br /> further evaluation or conditional pass. In this case, the septic system was installed in accordance with the 78 <br /> Code. Title V minimum requirements are for septic systems to be 4 feet above groundwater. For this reason, <br /> John Grad sued on his inspection form that the system needed further evaluation by the BOH. <br /> Glen Harrington stated that he did not believe the system had been installed in violation of the 78 code, because <br /> the water table has risen since that time. Glen's feeling was that the leaching facility system should pass <br /> 2 <br />
