1 _ TOWN OF MASHPEE BOARD OF HEALTH -- PUBLIC MEETING Minutes of the Meeting-of Thursday, November 3, 2005 Board Members Present: Also Present: Steven Bali, C6-Chairman Glen Harrington, Hearth Agent Lucy Burton,'Clerk Veronica Warden, Assistant Health Agent Board Members Absent: Glenn Santos Co-Chairman Steven Ball called the meeting to order at :00 PM. Lucy Burton made a motion to adjourn the meeting and move the meeting from the Board of Health office to Town Hall Conference Room 1. Steven Ball seconded the motion. All approved. Co-Chairman Steven Ball called the meeting to order at 7:07 PM. APPOINTMENTS Evelyn Fernandes—Show cause Hearing. Evelyn Fernandes' attorney requested a continuation of the'h adng until the next BOH meeting. Lucy Burton moved that the Board approve the request for continuation of the Show Cause hearing for Evelyn Fernandes until the next BOH Public Meeting. Steven Ball seconded the motion. All approved. Date of the next meeting is TBD. Fred McDuffy—29 Devonshire Road. Fred McDuffy was not in attendance at the meeting. Mr. l lcDuffy reported to Glen Harrington prior to the BOH meeting that the property is now hooked up with Town water, and the betterment is complete. He is now requesting that his$650 in fines be modified. Steven Bari moved that the request by Mr. II cDuffy to modify the$650 in fines be denied. Lucy Burton seconded the notion. All agreed. Daphne Macera—26 Little Neck Lane. Glen Harrington provided background information on, the situation. Inspector John Graci conducted a septic inspection,.as the property is up for sale. He reported that there are two cesspools on the property. One is under the driveway, and hes a cracked top. The other one is ori the edge of the ddveway, and is structurally sound, except that it is just 32 feet from the salt marsh and does not meet the Title V requirement that it be no less than bo feet back from the salt marsh. The DEP considers the cesspools to be failed. At the last BOH meeting, it was determined that the cesspools did impact the health of the environment, and needed to be upgraded with denite and ultraviolet. The owner, Daphne Macera, a widow with limited income and in poor health, has appealed the decision, citing financial hardship. Title V requires that decision appeals must go through the Superior Court. Daphne Madera introduced herself to the Board. She stated that she is a widow with limited income, in poor health. She has had two engineering estimates to upgrade the two cesspools, and would find the upgrades to be a severe financial hardship. Stevan Ball stated that there is a Community Septic Loam program available which offers low loan rates. T1s. Macera felt that talking on such a loam would be beyond her ability to handle.
