1 _ <br /> TOWN OF MASHPEE <br /> BOARD OF HEALTH -- PUBLIC MEETING <br /> Minutes of the Meeting-of Thursday, November 3, 2005 <br /> Board Members Present: Also Present: <br /> Steven Bali, C6-Chairman Glen Harrington, Hearth Agent <br /> Lucy Burton,'Clerk Veronica Warden, Assistant Health Agent <br /> Board Members Absent: <br /> Glenn Santos <br /> Co-Chairman Steven Ball called the meeting to order at :00 PM. <br /> Lucy Burton made a motion to adjourn the meeting and move the meeting from the Board of <br /> Health office to Town Hall Conference Room 1. Steven Ball seconded the motion. All approved. <br /> Co-Chairman Steven Ball called the meeting to order at 7:07 PM. <br /> APPOINTMENTS <br /> Evelyn Fernandes—Show cause Hearing. Evelyn Fernandes' attorney requested a <br /> continuation of the'h adng until the next BOH meeting. <br /> Lucy Burton moved that the Board approve the request for continuation of the Show Cause <br /> hearing for Evelyn Fernandes until the next BOH Public Meeting. Steven Ball seconded the <br /> motion. All approved. <br /> Date of the next meeting is TBD. <br /> Fred McDuffy—29 Devonshire Road. Fred McDuffy was not in attendance at the meeting. Mr. <br /> l lcDuffy reported to Glen Harrington prior to the BOH meeting that the property is now hooked up <br /> with Town water, and the betterment is complete. He is now requesting that his$650 in fines be <br /> modified. <br /> Steven Bari moved that the request by Mr. II cDuffy to modify the$650 in fines be denied. Lucy <br /> Burton seconded the notion. All agreed. <br /> Daphne Macera—26 Little Neck Lane. Glen Harrington provided background information on, <br /> the situation. Inspector John Graci conducted a septic inspection,.as the property is up for sale. <br /> He reported that there are two cesspools on the property. One is under the driveway, and hes a <br /> cracked top. The other one is ori the edge of the ddveway, and is structurally sound, except that <br /> it is just 32 feet from the salt marsh and does not meet the Title V requirement that it be no less <br /> than bo feet back from the salt marsh. The DEP considers the cesspools to be failed. At the last <br /> BOH meeting, it was determined that the cesspools did impact the health of the environment, and <br /> needed to be upgraded with denite and ultraviolet. The owner, Daphne Macera, a widow with <br /> limited income and in poor health, has appealed the decision, citing financial hardship. Title V <br /> requires that decision appeals must go through the Superior Court. <br /> Daphne Madera introduced herself to the Board. She stated that she is a widow with limited <br /> income, in poor health. She has had two engineering estimates to upgrade the two cesspools, <br /> and would find the upgrades to be a severe financial hardship. Stevan Ball stated that there is a <br /> Community Septic Loam program available which offers low loan rates. T1s. Macera felt that <br /> talking on such a loam would be beyond her ability to handle. <br />
