The Board agreed to continue the leaning until the next <br /> scheduled BOH meeting on 12115105. <br /> OLD BUSINESS <br /> No old business. <br /> NEW BUSINESS <br /> Sign Warrants. The Board members signed the warrants. <br /> Review Minutes of October 20, 2005. The Board unanimously approved the minutes from the BoH <br /> Public Meeting of 10/20/05. <br /> Request for BOH Variance: 55 Hoopole Road,, Irrigation Well <br /> Prop rt r owners Geoffrey and Janet Willis are requesting a variance from BOH regulation Part XIX, <br /> Sectin 3, to install an irrigation well in an area of known contamination. <br /> Glenn Santos rade a motion to deny the request for variance from the BOH regulation Part XI , Section <br /> 3, due to the past history of other irrigation wells being installed in contaminated areas and high C}s <br /> being detected. Luer Burton seconded the motion. All approved. <br /> Request uest for 80H Variance: 55 sunset circle,cape& Islands Representing <br /> Cape & Islands Engineering is requesting approval for the following variances at 55 Sunset Circle: <br /> 1 the proposed soil absorption system will be ' to the Board of Vegetative Webands(BVW), <br /> log 1 required <br /> 2 the reserve soil absorption system wili be 3' to the BVII , 100' required <br /> 3 approval to install a denitrification unit and DV light. <br /> Lucy Burton made a motion to approve the variances requested for 55 Sunset Circle. Glenn Santos <br /> seconded the motion. All approved. <br /> Tobacco compliance Inspections Update <br /> Veronica Harden reported #hat on l' ovember 9, 2005, staff from Cape Cod Reg Tobacco Program <br /> CC TBC completed a round of compliance checks of tobacco retailers in r a hpe . They reported that <br /> Johnny's Tune& Lube.on Rt. 28 in Mashpee had sold cigarettes to a minor. Further investigation by <br /> Veronica Warden revealed the fact that Johnny's Tune& Dube has never had a permit to sell tobacco. <br /> Glenn Santos-made a 'notion that the BOH send a certified letter to Johnny's Tu ne.& Luba notifying them. <br /> that they are being fined $100 for violation of the BOH requirement to have a permit to sell tobacco <br /> products. Further, ,Johnny's Tune& Lube is ordered to appear before the BOH on Dec. 15 1h3 2005, for a <br /> "Show Cause" hearing as to why they do not have a tobacco permit. if Johnny's Tune & tube does not <br /> appear before the BOH on 12115105, and they are still selling tobacco products, they will be fined$100 <br />
