TOWN OF 1 <br /> BOARD OF HEALTH — PUBLIC MEETING <br /> Minutes of the Meeting Thursday, December 15, 2005 <br /> Board M rnbers Present: Also Present: <br /> Glenn Santos, Chairman Glen Harrington, Health Agent <br /> Steven Ball, Co-Chairman Veronica Warden,Assistant Health Agent <br /> Lucy Burton, Cleric <br /> Chairman Glenn Santos ca-lied the meeting to order at 7:03 PM. <br /> APPOINTMENTS <br /> Mike Minor—MMR Update <br /> Mike Minor introduced himself to the Board, and displayed a map of the area In l a hpee where <br /> plumes are located as related as to contamination from the Base. There is a fuel spill in the <br /> uashnet bogs; here is a chemical spill in John's Pond. Mike distributed four figures that displayed <br /> TC E Detections; Backward and Forward l Parkle Tracks from Residential Well in fa tepee# sot 9 <br /> Leading Edge Cross-section Lines; and CS-10 Leading Edge Dross-Section D-D, Mike stated that <br /> TCB was found in a private well sampling, which was not doming from the base. There is a <br /> separation of 150 feet betwen the base and the private well. Mike stated that the Regulatory <br /> Agency and the DEP.feel that there are sufficient monitoring wells, and thea are no plans to drilf n' <br /> additional wells. <br /> The Board thanked Mr. Minor for his presentation. Mike-stated that he would come at feast twice a <br /> year to provide a full report to the BOH. <br /> Johnny,Wtern(Johnny's Tune& Lube)-}"'Show cause" Fearing re: Tobacco sales Violation <br /> Jack Hatem, General Manager of Johnny's Tune& Lube, introduced himself to the Board. Veronica <br /> Warden reviewed the case for the Board. n'll 1./09/05 a Tobacco Compliance Check vwras conducted <br /> at Johnny's Tune&Lube, 723 Falmouth Road, Mash ee, and found that cigarettes were sold to <br /> minor. Further, it was discovered that the establishment had nearer had a permit to self tobacco. A <br /> certified fetter was sent to Tine& Lube ordering them to discontinue sale of all tobacco products, and <br /> notifying them they were being fined$loo for selling tobacco products to a minor, which is in violation <br /> of the Mass. General Laws. They were ordered to appear before the 12/15/05 BOH meeting to show <br /> cause why tobacco products are Being sold at the facility without a permit. Tuesday following delivery <br /> of the certified letter, tobacco products were found at the l land between the gas pumps. Veronica <br /> directed the sure manager to remove the products from the island. At this date, the store is under <br /> orders to cease and desist all sales of tobacco products. <br /> Jack Hatem stated that the Johnny's Tune& Lube new store in Falmouth has a tobacco permit but <br /> the main store in Falmouth does not Mr. Hatern stated that his understanding was that only one <br /> permit was rewired, which would cover all Johnny's Tune& Lube sures. <br /> fetter from Dunning & f irrane dated November 2000 states that the Zoning Board of APp els had <br /> ruled that no tobacco safes are permitted in the area of the Johnny's Tune& Lube at 723 Falmouth <br /> Rd. in Mashpee. <br /> Glenn Santos made a motion that Johnny's Lube and Tube must cease and desist the sale of all <br /> tobacco products until they determine from the Zoning Board of Appeals whether or not the ruling <br /> stated in the Dunning & t irrane letter of November r 2000 is still valid. if it is determined that tobacco <br /> sales are now permitted in the area of Johnny's Tune& Lube, Jack Hatern must come before the <br /> B H to apply for a permit to sell tobacco products at the facility. Steven Ball seconded the motion. <br /> All approved. <br /> I <br />
