<br /> Lucy Burton moved that the Board go into Executive Session at 9.55 PM. Lewis Mantel
<br /> seconded the motion. All approved.
<br /> Boll Call: Glenn Santos, Lucy Burton, Lewis Mantel.
<br /> Glenn Santos: The purpose of the session is to discuss potential legal litigation for Exxon-Mobil.
<br /> obil.
<br /> Glen Darrington: Where we are right noir with Exxon on Mobil is that there was an agreement to
<br /> extend or issue a temporary certificate f occupancy until,dune 18th so that-we could have a-
<br /> meeting with both parties and their Counsels, and that meeting occurred on May 21't, and we
<br /> were supposed to have a meeting on May 23rd but we didn't have a meeting on May 23rdand that
<br /> actually worked out even though we didn't have a meeting. But it's just that we are now corning
<br /> down to the wire here because this meeting here tonight was supped to be the drop dead date
<br /> as fay-as when the Board needed to make a determination whether to accept the terms right now,
<br /> which is$8,750 on the table set by Mobil's counsel Attorney Cohen, and our point where we are
<br /> at is$151 0 g from which was originally decided from$25,000 and then$151 000 through the
<br /> meeting with Glenn on the 21 st
<br /> .
<br /> Glean Santos: It was somewhat contradictory because Patrick Costello stepped out with their
<br /> lawyer and then we went back out into the hallway and had our little side bar and they had their
<br /> little side bar, and they first started out at$2,000 or something like that and we said"No,
<br /> $40,000", and we were going back and forth and it was something like an arbitrated type of thing.
<br /> But their lawyer did come out and say that they were authorized to do$10,000, and they carne up
<br /> with $8,750. And you passed that and said that they had just contradicted themselves. And they
<br /> also said that they didn't care if they had to pay the fine, it didn't make any difference if it was a
<br /> fine or if it was they are going to pay for the P _ The thing I disliked at the end, and everything
<br /> was going really good, and remember vire talked about this at the end, was that their lawyer
<br /> turned around and said, "Well if you people feel like you've got to look like heroes and get money,
<br /> then this is the best wre're king to do." And I took that as ars offense, because.everything was
<br /> really amicable and going along really good,and we were ging to where we always said if we
<br /> get up to around$15,000420:000# that would be acceptable. The point we were trying to get to
<br /> therm is that they are going to spend that on that lawyer on any litigation just going to court. This
<br /> guy is not going to coma:chem_ The same thing with the Town. I'm sure if is not going to cast as
<br /> much because of the contract we have with Patrick, but still, Iefs just say the aggr vabon, okay,
<br /> and it seemed like we came down the most and they didn't want to go, and I said to Patrick, 'I'm
<br /> not going to go anything less than $15,000, so he said, `i`I think$20, 000 something whatever"
<br /> and he said maybe could talk therm down to$15,000 and that's patty much when it ended. I
<br /> took offense at their last comment. And they were patty much getting up ready to leave and he
<br /> goes, "IJlfell if you guys really errant to look like heroes then this isn't going to work". And that's not
<br /> the point.
<br /> Lucy Burton: The point is they were in violation, they were fined and they haven't paid, correct?
<br /> Glenn Santos: Like I said, everything was going along good until that last comment and then I
<br /> know you people, we both looked at each other when it was said, and it was like we took offense
