<br /> haven't reached ars agreement or if they haven't paid heir fine, what happens on Monday?
<br /> Glen Harrington: That, I'm not fully sure of, exactly how that's going to work. l know that Pet was
<br /> not comfortable about keeping the sure closed because thea they would come back to us for
<br /> damages. And he's saying that is opening the Town up to very severe penalties even beyond
<br /> whatever the fine is.
<br /> Lewis Mantel: What does he recommend?
<br /> Glen Harrington: Honestly I only tanked to him about the tine, I'm not sure how he wanted to
<br /> handle the actual occupancy. The fine, he thins they will come to$10,000 and possibly a little
<br /> more.
<br /> Glenn Santos: But we haven't heard anything from them?
<br /> Glen Harrington: Right, And he's right. file's been talking to Attorney Cohen and nothing else
<br /> has been put on the table.
<br /> Lucy Burton: Why are we cutting the fine down to a quarter? It seems that we at the most should
<br /> meet at the middle. This is their violation, their fine, why are we cutting it down to$10,000? They
<br /> are the ores that were in violation and making their staff and anyone who needed to wash their
<br /> hands or use the restr oms walls across a highway and down into Mashpee Commons to use the
<br /> restroorns. And they had water from the carwash that was going out onto Rt. 28, and septic that
<br /> was in failure. The,molded food was a separate issue, correct?
<br /> Glenn Santos: They paid their fine for that. The biggest problem was, they said their piece as far
<br /> as they think that they have a goad vase that they can beat, and Pat was very good, he said,
<br /> listen, your know, because thea we talked about it afterwards, we brought up some good points.
<br /> What Glen and I remember at the beginning, it says right on the Inspection Report that one of the
<br /> i problems they were having is that the bull run valve was not even there, or they had it in the D
<br /> Box,they haat one of the pipes plugged off. But, and l remember when we first stand, Ronnie
<br /> said, " I'm going to dig up some because what happened was the primary went on failure." They
<br /> went on reserve, and then they said no we're going to switch it back, and thea they switched it
<br /> back and it was still in failure. Even all those year's it wasn't working it was s ll in failure. In a
<br /> couple of days it was bubbling crude again. So it's like, okay you knew about it, you were aware
<br /> that the primary failed, and Pat laid it right out, and that's
<br /> Glen Farrington: We backed off on the tight tank portion of the carr wash because that is actually
<br /> DEP jurisdiction. And we reclosed it every time it overflowed and we sfill did it correctly as far a
<br /> ghat we did about it but we notified DEP, it was really up to therm to issue a noncompliance.
<br /> Glenn Santos: But their interpretation, what they are convinced at is that in Tide V if you pump
<br /> the system or whatever like that it is considered a repair, okay. So, next day you bubble crude
<br /> again, so you keep doing those repairs, and it is not a repair. And the interpretation of what, -you
<br /> should get a better a planabon of it, Glen, but that's where the difference lies.
<br /> Glen Werrington: That's what they were saying,that the way the letter was written, as far as
<br /> repairing the soil absorption system,was vague, and they think they have a strong case to make
<br /> in court that the actual order to repair the septic system was vague. And that is basically what
<br /> they are hanging their hat on as far as the interpretation of what the repairs meant. And they are
<br /> also saying they had additional time, they could have had two years to fix it because nowhere in
<br /> the order letter also does it say that there was ars imminent threat or that there was an emergency
