Q - <br /> TOWN of MAS PEE <br /> BOARD of HE .LTH—PUBLIC MEETING <br /> i <br /> Minutes from the Meet!ng of-Wednesday,August 8, 2007 <br /> Board Members Present: Membem MemberAbsent: Also Present: <br /> Lucy Burton, Chairman Glean Santos, Vice Chairman Glen Harrington, Health Agent <br /> Dr. Lewis Mantel, clerk <br /> Chairman Lucy Burton called the meeting to order at 7:00 PM. <br /> APPOINTMENTS <br /> 7:15 PIS—Baxter Nye/Brian Tamborelli-Request for Food Establishment Permit at Deer <br /> Crossing <br /> The'aapplicants requested that the discussion be continued until the next BOH meeting on August 22, <br /> 2007. <br /> 7:30 PINI—Joseph Gatto—14 Regatta Drive <br /> Glen Harrington commented that on July 30th 2007'a request was-received by the BOH for a permit to- <br /> repair a lire replacement from the house to the septic tank at 14 Regatta Drive. That afternoon the <br /> dt 130H received a call to do an inspection on the property, where Glen Harrington met Joseph Gatto, <br /> owner of the property. The new lire was already installed so Glen had to look at the eising line which <br /> had-been removed There was a lag made in the.1ine when installed,which had caused a.blockage in <br /> the line. Reports from other Regatta Drive hom owners said the lige had backed up, and they had <br /> experienced significant expense to get the line repaired. The homeowners were inquiring as to the <br /> nature of the problem. Joseph Gatto requested an audience with the BOH to determine what, if <br /> adythin ,.the Board could do on behalf of the neighbors on Regatta Drive. Glen Harrington reported <br /> that the line,had been repaired and inspected and the systern'was now in compliance. <br /> Julie Gatto, mother of Joseph Gatto, owner of the property-at 14 Regatta Drive, introduced herself to the <br /> Board. she stated that Joseph Gatto 4as-the second owner of the property, taking ownership hip ire <br /> December,_ o . Backup problems occurred at 14 RegattaDnove in 2005 and 2007. Kenneth Babcock,---_-_ <br /> Gail Jones, Priam Curren, Paul Candolara, Sue Hayes, and Daren.felly, @11 residents on R6gatta Drive: <br /> introduced themselves to the n'eeting and stated that they are.all concerned about possible septic <br /> backup problems. seNi a calls from Omni Environmental-Systems,Vernon Whitely Plumbing, Inc., <br /> Ready Footer, capewide Enterprises, and E.F.Winslow Plumbing all indicated it was not a plumbing <br /> problem; it was a blockage in the system which was causing the backup. The Regatta Drive residents <br /> are trying to resolve the issue of who is responsible for the backup problems affecting their properties. <br /> Lewis Mantel stated that this becomes a civil matter between the Regatta Drive residents and <br /> Assurance om, pany for the performance of their employees'work. <br /> Olen-Ha rrington'stated that the time when the BOH would get involved in this kind of problem was at the <br /> time of in of the septic system when there 'wras some direct evidence of negli ehce on the part <br /> of the 'installer of the septib system. The installer,William Dinger, is'no longer with Assurance and i no <br /> longer licensed b tl�he I ashpee B H. The BOH therefore has ho direct jurisdiction over Mr. Dinger. <br /> Karen Kelly, Regatta Drive resident, introduced herself to the Board. She stated that the septic <br /> installation on Regatta Drive was a botched job, and Omni is charging all kinds of money doing <br /> inspections and the residents never see reports of their inspections. <br /> Lewis Mantel stated that the Mate grams the license to the manufacturer of the particular alternative <br /> system. The property owners have a maintenance contract which has to be kept for the life of the <br /> system. • <br />
