i <br /> t <br /> i <br /> F TOWN OF MASHPEE <br /> BOARD of HEALTH -^ PUBLIC SESSION <br /> Minutes of the Meeting f Thursday, February 26, 2009 <br /> Board Members Present: Also Present: <br /> Lucy Burton, Chairman Glen Harrington, Health Agent <br /> Burton Kaplan, Vice Chairman <br /> Ialliope Egloff, QIerk <br /> Chairman Lucy Burton called the meeting to order at 7:09 PM. <br /> i <br /> APPOINTMENTS <br /> 7:15 PM—Cavossa Disposal Inc. —Show cause Hearing (continued) <br /> Carl Cavossa, of Cavossa Disposal Company, introduced himself to the Board. <br /> Glen Harrington stated that at the 1/28/09 BOH meeting, the Board agreed to defer any <br /> action taken on renewal of the Cavossa- Disposal, Inc. Waste Hauler's Permit for 2009 <br /> until after a meeting scheduled for 2113109 had occurred, with Joyce Mason, Catherine <br /> Laurent, Town Counsel, Glen Harrington, Lucy Burton, and Carl Cavossa in attendance. <br /> At the meeting, which was held on /13/09, Carl Cavossa explained his position to the <br /> group reiterating the issues he had voiced at the BOH meeting on 1128/09. As a result <br /> of the meeting, Town Counsel had the following recommendations to the BOH: <br /> 1. that the B H must expend equal effort against all waste hauler violators— i <br /> must not engage in selective enforcement <br /> 2. re: the issue of 4 months ofno deliveries of commercial waste by Cavossa <br /> Disposal, Inc. to the UCRTS in 2008', after confirmation by the BOH from regular <br /> Cavossa customers that their waste had been picked up during those months, <br /> Counsel considered this to be in violation of the 130H regulation, and <br /> recommended that a $900 fine be charged to Cavossa Disposal, Inc. for this <br /> offense. <br /> 3. that a Refuse Hauler's Permit for 2009 be issued to Cavossa Disposal, Inc. upon <br /> payment of the referenced $900.fine. <br /> Lucy Burton made a motion that Cavossa Disposal, Inc. be fined $900 for not delivering <br /> its waste to the UC TB during 200 8. The 2009 Refuse a Hauler's Permit may be issued <br /> to Cavossa Disposal, Inc., upon receipt of the $900 fine payment. Burton Kaplan <br /> seconded the motion. All approved. <br /> 7:30 --Waste Management—Shover cause Hearing - Refuse <br /> Glen Harrington stated that on February 13, 2009, as a result of information submitted to <br /> the BOH from{the DPW, an order letter was seat to Mr_ John Cedergui t of Waste <br /> Management of MA., with ars order to appear before the BOH on 2126109 to "show <br /> cause" as to why Waste Management was not disposing of its 1 lashpee commercial <br /> refuse at the UCRTS. <br /> Mr. Cedar uist responded to the 130H, stating that all their waste, both residential and <br /> p . <br /> commercial, was co-mingled and taken to the UCRTS and dumped as residential waste, <br /> thereby making it impossible for Waste Management to submit any reports on amount <br />
