Glen Harrington stated that the requirement to <br /> separate commercial waste from residential waste is not part of the BOH regulation, but <br /> is part of the agreement between SEIIASS and the Torun of Mashpee. The BOH has no <br /> jurisdiction over the Town's agreement with SEMASS. Therefore, Catherine Laurent <br /> and the Board of Selectmen will have to handle the enforcement of their agreement. <br /> Bill Sullivan, with Cavossa Disposal Inc., introduced himself to the Board. Mr. Sullivan <br /> stated that Waste Management has separate truckt each for commercial and residential <br /> waste, and therefore Waste Management must know w e actl how much commercial <br /> waste they had collected and dumped during 2008. Glen Harrington stated that Town <br /> Counsel had confirmed that the Town could levy fines on Waste Management for each <br /> month of 2008 that they had collected commercial trash from the Town of Mashpee and <br /> dumped it at the UC TS without reporting it. <br /> Glen Harrington stated that should the Board of Selectmen determine that Waste <br /> Management is in violation of the Town's regulation, the BOH then has the right to <br /> revoke the company's Mashpee Waste Hauler's Permit until any assigned fines for the <br /> violation are paid. Glen Darrington started that Catherine Laurent will keep the BOH <br /> informed as to the outcome of the handling of the issue with Waste Management by <br /> DPW and the Board of Slecten. <br /> 7:46— Mick suke—show cause Hearing—septic violation <br /> Glen Harrington stated that on September 27, 2007, Scott Torrey, a Mashpee-licensed <br /> septic installer, obtained a permit from the BOH for installation of a new septic system at <br /> Bayshore Drive. The site and design plans were drawn by canal Land Surveying and <br /> Permitting. In January, 2008, the septic system was Installed. Recently Roger <br /> Michniewic , a representative from Canal Land Surveying, supped by the BOH office to <br /> drop oft the As Built cards, which indicated that Nick l Soul a was the septic installer at <br /> aysh re Drive. Glen Harrington started that the BOH sent an order letter to Mr. S in e, <br /> dated 210 , ordering him to appear before the BOH on 2126109 to"show cause" as t <br /> why he had violated Title V regulations by installing the septic system at 2 Bayhore <br /> Drive without having obtained a septic installation permit from the BOH. <br /> Nick Souke introduced himself to the Board. He started that he had been a Mashpee- <br /> licensed septic installer for three years. Mr. Bourke stated that he received the BOH <br /> "Shover Cause" letter last Thursday moming and cage immediately to the BOH to clear <br /> up the matter. Mr. souke stated that when he care in n Dec. 22nd) 2008 to rene w his <br /> septic license, he was handed a packet With two As-Built,cards. After renewing lois <br /> license, Mr. S uke stated that he installed the septic system at 2 Bayshore Drive, had <br /> two inspections, filled out theAs-Built cards, and has been trying ever since to get paid <br /> from the contractor. The contractor is "MES"from New Hampshire, and also is the <br /> owner of the property at 2 Baysh re Drive. Mr. Bowe started that he had no knowledge <br /> of.the fact that the septic permit was not in his name, but in the contractor's name, and <br /> had no malicious intent whatsoever. <br /> Lucy Burton made a-motion to dismiss the case against Mr. Soule.
