Moriarty states that sea Dabs understands and appreciates that the DEP has requested <br /> the BOH to refer all septic repairs of properties over 10,000 gpd to the DEP. In this <br /> circumstance, however, the DEP has no basis to assert jurisdiction under the more <br /> stringent provision of Part IAC, 17.00 8.1, and the Sea Oaks Board respectfully requests <br /> that the lashpee Board of Health authorize the repair of the soil absorption system for <br /> Building 17. Mr. Moriarty requested a response to his 15109 letter to the Board of <br /> Health by 4130109. <br /> Burton Kaplan made a motion to continue consideration of the request submitted by <br /> Thomas Moriarty on behalf of Sea Oaks Condominium until the Board of Health hears <br /> from Brian Dudley of the DBP. Calliope EglofF seconded the motion. All approved. <br /> OLD BUSINESS <br /> 1. Kennel Application: 225 Ashu rnet Road (continued from 3125109) <br /> Lucy Burton made a motion to continue the fennel Application at 225 Ashumet Road <br /> pending further review by Town counsel. A-Plus Waste Removal <br /> l <br /> Glen Harrington stated that 30 days have elapsed since the BOH meeting on /15109 <br /> F during which the Board passed a motion that if within 30 days of 3!25!09 Mr. Ron High of <br /> A-Plus Waste Removal had not complied in full with the Refuse Regulation, the SOH <br /> would tape the following punitive action: <br /> • <br /> Issue a $1000 fine for operating without a permit <br /> Issue a cease and Desist order to stop operating in the Town of i lashp a until <br /> the following requirements were met: setting up an account with DEP and DPW <br /> for use of the UCRTS, and providing a $1000 Performance Bond to the Board of <br /> Health. <br /> Glen Harrington reported that he has heard nothing from Nor. Mama Stella's <br /> Glen Harrington reported that Varna Stella's had been assessed a $100 fine for non- <br /> payment <br /> n- <br /> pa ment of their residential kitchen permit renewal fee by 1101109.
