Kalliope Egloff made a motion that the Board require a fully executed contract by February.1 20123 <br /> receives evidence of fiscal compliance, also a.commitment to design a system by February 1, 2012, <br /> and 45 days after the closing which would be around March'8, 2012, the Board requires fully <br /> executed engineering plans. The Board requires that the system be in plane no later- than Jure 30, <br /> 2012, and no occupancy,until the system is verified to be in place at 6 Dean's Hollow. Burton.Kaplan <br /> seconded the motion. The motion was unanimously approved. <br /> OLD BUSINESS <br /> 1. Title V Variance for Septic Upgrade: 82 Nick Trail — Paul Hanlon. <br /> Glen Harrington stated that an enforceable agreement is in place with Mr. Hanlon to have the septic <br /> tank replaced by February 1 4,,201 2. However, it was disovered.that the septic tank is within 10 feet <br /> of the abutting side property lire. A permit has been obtained by Pastore Excavation to do the <br /> replacement. Since no engineering was required, Mr. Hanlon is to'notify his abutter that a septic <br /> repair would be occurring within ten feet of their property line. Mr. Hanlon provided a notice to M . <br /> Sullivan. Glen Harrington spoke to M . Sullivan, and she indicated that she received the notice and <br /> had. no cornments. <br /> Kalliope Egloff made a motion that the Board approve the permit for 82 Nick Trail to replace the <br /> septic system with the sideline property va-ria rie within 10 feet of the abutter at Nil Trail. Burton <br /> Kaplan seconded the r oti n. The motion was unanimously approved. <br /> ADDITIONAL TOPICS <br /> Glen Harrington received a call from Catherine Laurent that Cavessa Disposal and one Pointe Horne <br /> Curators are in arrears on their payments to the Town. <br /> DISCSSI -N <br /> Innovative/Alternative Septic System Compliance <br /> The County oversees the Carmody data base. This data base is where all the I/A operators submit <br /> their results, and the operators enter all the information that they find at the properties that have an <br /> IA system. Glen Harrington stated that since Mashpee has the most IA systems, vire have the most <br /> that are out of compliance. There are several violations that seasonal people are turning off the <br /> electricity to the systems. Failure to maintain a contract is another violation. DEP-approved seasonal <br /> use without the Town's knowledge. <br /> This discussion-is continued to the net meeting on February 8, 2012. <br /> Burton Kaplan made a motion that the Board adjournJhe Public Session meeting.
