Town of Mashpee <br /> Z <br /> :*{.. 6 Great Neck Road Na <br /> Mashpee, Massachusetts 02649 <br /> F <br /> BOARD of HEALTH - PUBLIC SESSION <br /> Minutes of the Meeting f August 8, 2012 <br /> Board Members Present: Member Absent: Also Present: <br /> R <br /> Burton Caplan, Chairman Lucy Burton, Clerk Glen Harrington, Health Agent <br /> Kalliope Egl ff, Co-Chairman <br /> Chairman Burton Kaplan called the meeting to order at 7:00 PIIS. <br /> t <br /> APPOINTMENTS <br /> TS <br /> 7:15 PIIS — Mary Wheatley—Tale V Variance Captains Row. <br /> Mary Wheatley of 84 Captains Row introduced herself to the Board. <br /> Mrs. Wheatley commented that she spoke to Glen Harrington about a variance for her cesspool. Mrs. <br /> Wheatley stated that the Sloans; the buyers, have agreed to do the necessary work to upgrade the <br /> system so that she would be able to transfer the property-to therm. <br /> Don Sloan stated that the closing date is scheduled for August 31, 2012. After this date Mr. Sloan <br /> plans on using-this property as a rental property.-Mr. Sloan was under the impression that a new <br /> septic system could be installed within the next year. <br /> Glen Harrington stated that in cases where the house is demolished and rebuilt more time is given to <br /> install a new septic system. The Burd allows 6 months for the installation. However, the length of <br /> time the Burd grants for installation for an existing home is 3 months. The three months begins from <br /> the dame of the closing in which the septic system has to be designed and installed with the Certificate <br /> of Compliance issued within that -day time frame. <br /> The Sloans are claiming a financial hardship and cannot meet the 3-month deadline. Purchasing the <br /> property and then having to install a neer Title v septic system, makes it difficult for thern•finanoially. <br /> The Sloans are planning on installing the new system in the spring. <br /> Burton Caplan stated that if the Board were to give the Sloans a -month time frame, the Board <br /> would be setting a precedent, and.the Sloans would be obliged to meet that deadline. Since the <br /> Board is dealing with a financial hardship, it would be justification for allowing 3 additional months. <br /> Burton Caplan stated that he and Kalliope Egloff are not in favor of extending the time frame beyond <br /> months. <br /> Kalliope E loff rade a motion that-in regard to 84 Captains Roar the Board.of Health receive an <br /> Enforceable Agreement by August 15, 2012, engineering plans for a new septic system by October <br /> 103 2012, and a neer septic system is to be installed by February 20, 2013, and be notified when <br /> each of the deadlines are met. Bunton Caplan seconded the motion. The motion was unanimously. <br /> approved. <br /> 1 • <br />
