Mr. <br /> Blaisdell read the Conservation C©nunents and the Board of Health into the record;"Septic <br /> inspection report on file covers the requirement for increase in flow. 1995 septic permit <br /> was approved for 3 bedrooms. Floor plans have been reviewed and are acceptable for 3 <br /> bedrooms." <br /> There were no more comments from the Board or audience. <br /> Mr. Goldstein made a motion to approve the application for 36 Riverside Road with the <br /> following conditions; A Certified Plot Plan —MBLU 119-126, 36 Riverside Road; <br /> Mashpee,MA. Date: Oct. 2,2017, Scale: 1 '=30', Drawn: RBS, Job#: S356, DWG. CPP, <br /> Eastbound Land Surveying, Inc. PO Box 442 Forestdale, MA. Signed by: Robb Sykes, <br /> P.L.S., 10-2-2017, Registered Land Surveyor. Floor Plans—36 Riverside Road, Mashpee, <br /> MA. Van Durme requests a Special Permit under §174- <br /> 45.4 of the Zoning Bylaws to allow for an accessory apartment on property located in an <br /> R-5 Zoning District, (Map 71 Parcel 183), Mashpee, MA. <br /> Ms. Janice Van Duane represented herself for the application and is asking for a permit to <br /> be able to rent the pre-existing apartment that was never fully executed by the previous <br /> owners. She purchased the property last June and was told that it was a legal apartment, <br /> and found out it was not. She said there was extensive water damage in the house, and it <br /> was recently repaired to bring everything up to code and the repair work included the <br /> apartment. She is asking for permission to rent the apartment which is located in the lower <br /> level. The apartment floor plan was changed due to the water damage and needed to be <br /> brought up to code. <br /> Mike Mendoza said that both the Inspection Department and the Fire Department did the <br /> necessary inspections and confirmed the work was up to code. Mr. Mendoza said she is <br /> following procedures, and if the house was sold, the new owner would need to come back <br /> to the Board. The previous owner never recorded the original decision, and there was no <br /> record of a building permit for the accessory apartment. <br /> Mr. Goldstein asked if the egress was okay. He wanted to make sure everything else was <br /> in accordance with the bylaw. Building Commissioner Mendoza confirmed that the egress <br /> was in compliance and the apartment up to code. <br /> 3 <br />
