MASHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> DECEMBER 13, 2017 <br /> If the Board were to hear this case tonight it would be impossible to approve it with these <br /> two outstanding cases. The applicant would therefore have the option to continue it, <br /> however,the Board is approaching the 100 day maximum time limit for an application and <br /> a normal continuance would not be applicable. The Board could hear the case and make a <br /> ruling, or the applicant could withdraw without prejudice and refile it. The final option <br /> available to the applicant would be for both the Board and applicant to sign a continuation <br /> agreement. <br /> Attorney Kirrane addressed the Board and said he executed a document extending the 100 <br /> day period, so the Board would not be in jeopardy of having granted any permit or any <br /> decision by default, and would like to continue the hearing until January 10, 2018. <br /> Mr. Goldstein made a motion that the Board allow and approve the applicant's request to <br /> extend the application for 29 Overlook Knoll Road until January 10, 2018. Mr. Gould <br /> seconded, yes, Mr. DeBarros, yes, Mr. Pittsley, yes, and Mr. Blaisdell, yes. All were in <br /> favor to allow for the extension request of 29 Overlook Knoll Road. (The applicant and <br /> Board signed a formal document that will be filed with the Clerk's office.) <br /> NEW HEARINGS <br /> 36 Riverside Road: Owner, James M.McCadden requests a Written Finding under§174- <br /> 17 of the Zoning Bylaws to allow for an addition and extension to an existing single-family <br /> dwelling on property located in an R-3 Zoning District, (Map 119 Parcel 126), Mashpee, <br /> MA. <br /> Mr. James McCadden represented himself for the application. He said he is looking to add <br /> an addition on his lot. Mr. McCadden referred to the 5.3 ft.jog on the plot plan, and would <br /> like to square off the area, and add a bedroom above. <br /> Mr. Goldstein asked if the area above the existing porch slab had a roof above and if it was <br /> open.. He also asked the applicant what the lot coverage was. He suggested that the <br /> applicant refer back to the engineer to add the existing and proposed figures on the plot <br /> plan. Mr. Goldstein also mentioned that the lot coverage should include the shed. If the <br /> shed is an issue with the lot coverage, you might want to remove it. <br /> Building Commissioner, Mike Mendoza made a suggestion that the Board can make"a <br /> condition that the applicant has to submit a site plan with the necessary information on that <br /> plan, as long it doesn't exceed the 20% lot coverage he can pursue a permit. If it doesn't <br /> have the information, either way he would have to re-advertise because he's only asking <br /> for a Written Finding and no relief for lot coverage. <br /> 2 <br />
